Article 227: Case-ending orders are not interim orders

คำสั่งของศาลชั้นต้นที่ไม่รับหรือให้คืนคำคู่ความตามมาตรา ๑๘ หรือคำสั่งวินิจฉัยชี้ขาดเบื้องต้นตามมาตรา ๒๔ ซึ่งทำให้คดีเสร็จไปทั้งเรื่องนั้น มิให้ถือว่าเป็นคำสั่งในระหว่างพิจารณา และให้อยู่ภายในข้อบังคับของการอุทธรณ์คำพิพากษาหรือคำสั่งชี้ขาดตัดสินคดี

An order of the court of first instance refusing to accept or returning a pleading under Section 18, or a preliminary ruling under Section 24 that disposes of the entire case, shall not be regarded as an order made during the course of the trial, and shall be subject to the rules governing appeals against a judgment or a decision determining the case.

Section 227 opens Title 1 (Appeal) of Book 3 by classifying two specific rulings. An order under Section 18 that refuses or returns a pleading, and a preliminary ruling on a point of law under Section 24, are ordinarily interim in nature. But when either ruling disposes of the whole case, this Section removes it from the category of interim orders barred by Section 226 and places it under the rules for appealing a final decision. The provision must be read together with Section 228, which addresses the parallel situation where a Section 18 or Section 24 ruling ends only some issues rather than the whole case.

Why this matters in practice

The practical value is timing and cost. Because a case-ending Section 24 ruling counts as a final decision, you appeal it under the ordinary appeal rules rather than waiting until the end of trial, and you do not need to have entered an objection during trial as you would for a true interim order. Note also that an appeal against a Section 24 preliminary ruling on a point of law carries only the fixed court fee per instance, not an ad valorem fee based on the amount in dispute, which can make the appeal far cheaper.     Where the trial court gives a preliminary ruling on a point of law under Section 24 that disposes of the entire case, an appeal and a further appeal against it fall under Section 227, and carry only the fixed court fee of 200 baht per instance, not an ad valorem fee on the amount in dispute.

    The trial court decided a point of law that ended the whole case. The Supreme Court held that the appeal and further appeal were governed by Section 227, so the fee was the fixed 200 baht per instance under Table 1, and ordered the excess ad valorem fee the defendant had paid to be refunded.

  2. Arrêt de la Cour suprême n° 10260/2556 (2013)

    An order accepting an amended pleading is an interim order other than those listed in Sections 227 and 228. If the aggrieved party did not record an objection, the appeal against it is barred under Section 226.

    The trial court allowed the defendant to amend the defence. The Supreme Court held that this was an interim order not among those in Sections 227 and 228, so, absent a recorded objection, the plaintiff was barred from appealing it under Section 226.
