การยื่นอุทธรณ์ย่อมไม่เป็นการทุเลาการบังคับตามคำพิพากษาหรือคำสั่งของศาลชั้นต้น แต่คู่ความที่ยื่นอุทธรณ์อาจยื่นคำขอต่อศาลอุทธรณ์ไม่ว่าเวลาใด ๆ ก่อนพิพากษา โดยทำเป็นคำร้องชี้แจงเหตุผลอันสมควรแห่งการขอ ให้ศาลอุทธรณ์ทุเลาการบังคับไว้คำขอเช่นว่านั้น ให้ผู้อุทธรณ์ยื่นต่อศาลชั้นต้นได้จนถึงเวลาที่ศาลมีคำสั่งอนุญาตให้อุทธรณ์ ถ้าภายหลังศาลได้มีคำสั่งเช่นว่านี้แล้ว ให้ยื่นตรงต่อศาลอุทธรณ์ ถ้าได้ยื่นคำขอต่อศาลชั้นต้นก็ให้ศาลรีบส่งคำขอนั้นไปยังศาลอุทธรณ์ ในกรณีที่มีเหตุฉุกเฉินอย่างยิ่ง เมื่อศาลชั้นต้นได้รับคำขอไว้ก็ให้มีอำนาจทำคำสั่งให้ทุเลาการบังคับไว้รอคำวินิจฉัยชี้ขาดของศาลอุทธรณ์ในคำขอเช่นว่านั้นถ้าผู้อุทธรณ์วางเงินต่อศาลชั้นต้นเป็นจำนวนพอชำระหนี้ตามคำพิพากษารวมทั้งค่าฤชาธรรมเนียมในการฟ้องร้องและการบังคับคดี หรือได้หาประกันมาให้สำหรับเงินจำนวนเช่นว่านี้จนเป็นที่พอใจของศาล ให้ศาลที่กล่าวมาแล้วงดการบังคับคดีไว้ดังที่บัญญัติไว้ในมาตรา ๒๙๒
(๑) เมื่อได้รับคำขอเช่นว่านี้ ศาลอุทธรณ์จะอนุญาตให้ทุเลาการบังคับไว้ในกรณีที่มีเหตุฉุกเฉินก็ได้ โดยมิต้องฟังคู่ความอีกฝ่ายหนึ่ง แต่ในกรณีเช่นว่านี้ ให้ถือว่าคำสั่งนี้เป็นการชั่วคราวจนกว่าศาลจะได้ฟังคู่ความอีกฝ่ายหนึ่งในภายหลัง ถ้าศาลมีคำสั่งให้ทุเลาการบังคับไว้ตามที่ขอ คำสั่งนี้อาจอยู่ภายใต้บังคับเงื่อนไขใด ๆ หรือไม่ก็ได้ ศาลจะมีคำสั่งให้ผู้อุทธรณ์ทำทัณฑ์บนว่าจะไม่ยักย้ายจำหน่ายทรัพย์สินของตนในระหว่างอุทธรณ์ หรือให้หาประกันมาให้ศาลให้พอกับเงินที่ต้องใช้ตามคำพิพากษาหรือจะให้วางเงินจำนวนนั้นต่อศาลก็ได้ ถ้าผู้อุทธรณ์ไม่ปฏิบัติตามคำสั่งนั้น ศาลจะสั่งให้ยึดหรืออายัดทรัพย์สินของผู้อุทธรณ์นั้นก็ได้ และถ้าทรัพย์สินเช่นว่านั้น หรือส่วนใดส่วนหนึ่งเป็นสังหาริมทรัพย์ ศาลอาจมีคำสั่งให้เอาออกขายทอดตลาดก็ได้ ถ้าปรากฏว่าการขายนั้นเป็นการจำเป็นและสมควร เพราะทรัพย์สินนั้นมีสภาพเป็นของเสียได้ง่ายหรือว่าการเก็บรักษาไว้ในระหว่างอุทธรณ์น่าจะนำไปสู่ความยุ่งยากหรือจะต้องเสียค่าใช้จ่ายเป็นจำนวนมาก
English translation
The lodging of an appeal does not operate to stay execution under the judgment or order of the court of first instance. However, a party who has lodged an appeal may, at any time before judgment, apply to the appellate court, by motion setting out reasonable grounds for the application, for a stay of execution. Such an application may be filed by the appellant with the court of first instance until the time the court makes an order granting leave to appeal; after the court has made such an order, it shall be filed directly with the appellate court. If the application is filed with the court of first instance, that court shall promptly forward it to the appellate court. In a case of extreme urgency, when the court of first instance has received the application, it shall have power to order a stay of execution pending the appellate court's decision on that application. If the appellant deposits with the court of first instance a sum sufficient to satisfy the judgment debt, including the fees for the action and for execution, or provides security for such a sum to the satisfaction of the court, the aforementioned court shall stay execution as provided in Section 292.
(1) Upon receiving such an application, the appellate court may grant a stay of execution in a case of urgency without hearing the other party; but in such a case, this order shall be regarded as provisional until the court has subsequently heard the other party. If the court orders a stay of execution as applied for, this order may or may not be subject to any conditions. The court may order the appellant to give an undertaking not to move or dispose of his property during the appeal, or to provide security to the court sufficient for the sum payable under the judgment, or to deposit that sum with the court. If the appellant fails to comply with that order, the court may order the seizure or attachment of the appellant's property; and if such property, or any part of it, is movable property, the court may order it to be sold by public auction if it appears that the sale is necessary and proper because the property is perishable or because keeping it during the appeal would likely lead to difficulty or require a large expense.

Section 231 states the default rule that an appeal does not suspend execution, then sets out the routes to a stay. The power to grant a stay pending appeal belongs to the appellate court, with the application filed at the trial court until leave to appeal is granted and directly with the appellate court thereafter. The trial court retains a narrow emergency power to stay execution in cases of extreme urgency. A separate, self-executing route is the deposit of the judgment debt plus costs, or provision of satisfactory security, which triggers a stay under Section 292. Subsection (1) gives the appellate court flexible tools, including provisional urgent stays without hearing the other side, conditional stays, undertakings, security, and enforcement measures against a non-compliant appellant.
Why this matters in practice
Assume the winner can enforce the moment the judgment is out, so if enforcement would cause real harm, apply for a stay immediately and explain the urgency. Remember that the stay decision is the appellate court's own province: once it has ruled on a stay or on conditions like extending time to provide security, those orders are generally final and cannot be challenged by a further appeal. The most reliable protection is often to deposit the full judgment sum plus costs or post security, which secures a stay under Section 292. Where the appellant provides bank guarantees as security sufficient for the judgment sum, the court orders execution to be stayed under Section 231 paragraph three, and existing attachments are withdrawn.
After the defendant's bank accounts were attached, the defendant provided bank guarantees exceeding the sum in dispute. The trial court ordered execution stayed under Section 231 paragraph three and directed the enforcement officer to withdraw the attachment of the accounts.

A stay of execution during the appellate court's proceedings falls exclusively within the appellate court's power, which may impose any conditions under Section 231; this is a special procedure not subject to ordinary appeal or further appeal.
The Supreme Court held that stays of execution are allocated to each court by instance, and a stay during the appellate court's proceedings is exclusively that court's power, which may attach conditions under Section 231. A successor in title to the defendant therefore could not further appeal an order continuous with the appellate court's stay.

A ruling on an application to extend the time for providing the security on which a stay of execution was conditioned is continuous with the application for the stay itself, which is a power belonging exclusively to the appellate court under section 231. Where the appellate court affirms a refusal to extend that time, its judgment is final under section 147 paragraph one, so no further appeal lies from it - and that bar covers a further appeal complaining that the first court had no power to dismiss the stay application at all.
The appellate court granted a stay of execution pending appeal on condition that the defendant provide security within a time fixed by the first court. The first court extended that time three times, over some two months, and refused a fourth extension because the defendant had produced no evidence of any real effort to find security; the stay therefore lapsed, and the appellate court affirmed. The Supreme Court held that the extension question was continuous with the stay itself, a power belonging exclusively to the appellate court under section 231, and that the appellate judgment was accordingly final under section 147 paragraph one. The defendant had no right of further appeal, including on the argument that the first court should have referred the matter back to the appellate court, and the first court had been wrong to accept the appeal. The appeal was struck out and the court fee returned.
