When a party files a motion appealing against an order of the court refusing to accept the appeal, the court shall forward that motion without delay to the appellate court, together with the judgment or the decision determining the case of the court of first instance and the appeal. If the appellate court considers it necessary to examine the case file, it shall order the court of first instance to send the file to the appellate court. In such a case, the appellate court shall consider the motion and then make an order either affirming the refusal of the court of first instance or ordering that the appeal be accepted; this order shall be final, and shall be sent to the court of first instance to be read. When the order of the appellate court accepting the appeal has been read, the court of first instance shall serve a copy of the appeal on the appellee; and within seven days from the date the appellee files an answer to the appeal, or from the expiry of the period prescribed in Section 237 for filing an answer to the appeal, the court shall forward the answer to the appellate court, or notify it that there is no answer. When the appellate court has received the answer or such notification, the case shall be entered in the docket of the appellate court without delay.

Section 236 completes the mechanism begun in Section 234. On a motion challenging a refusal to accept an appeal, the trial court forwards the motion with the judgment and the appeal to the appellate court, which may call for the case file. The appellate court then either affirms the refusal or orders the appeal accepted, and, crucially, that order is final. The finality has an important consequence: where the appellate court affirms the trial court's refusal, the matter ends there and a further appeal to the Supreme Court is barred. If the appeal is accepted, the Section serves the copy on the appellee and forwards any answer, mirroring the flow in Section 235.

The finality rule under Section 236 catches many litigants: if the appellate court upholds the trial court's refusal of your appeal, that is the end of the road, and you cannot take the point to the Supreme Court. A trial court that nonetheless accepts a further appeal in that situation is acting contrary to this Section, and the Supreme Court will decline to consider it. So the challenge to the refusal under Section 234, decided by the appellate court under Section 236, is effectively your one and only shot. Prepare it thoroughly.     Where the trial court refuses an appeal and the appellate court dismisses the motion challenging that refusal, it is equivalent to affirming the refusal, and that order is final under Section 236 paragraph one, barring a further appeal.

    The trial court refused the purchaser's appeal; the appellate court dismissed the purchaser's motion challenging the refusal. The Supreme Court held this equalled affirming the refusal, which was final under Section 236 paragraph one, so the trial court's acceptance of the further appeal was improper.

  2. Supreme Court Judgment No. 4439/2558 (2015)

    Where the appellate court affirms the trial court's refusal of an appeal, that order is final under Section 236 paragraph one and a further appeal is barred, so the trial court's acceptance of the further appeal is improper.

    After the trial court refused the second defendant's appeal, the appellate court affirmed the refusal. The Supreme Court held the appellate order was final under Section 236 paragraph one and declined to consider the further appeal, correcting the fee order in passing.
