ถ้าคู่ความฝ่ายใดยื่นคำขอโดยทำเป็นคำร้องให้ศาลสั่งกำหนดวิธีการอย่างใด ๆ ที่บัญญัติไว้ในภาค ๔ เพื่อคุ้มครองสิทธิของคู่ความในระหว่างการพิจารณา หรือเพื่อบังคับตามพิพากษาหรือคำสั่ง ให้ศาลมีคำสั่งอนุญาตหรือยกคำขอนั้นเสียโดยไม่ชักช้าถ้าในเวลาที่ยื่นคำขอนั้นศาลจะชี้ขาดคดีได้อยู่แล้ว ศาลจะวินิจฉัยคำขอนั้นในคำพิพากษา หรือในคำสั่งชี้ขาดคดีก็ได้
English translation
If any party files a request made in the form of a motion asking the court to order any of the measures provided in Book 4 for the protection of the party's rights during the trial, or for the enforcement of a judgment or order, the court shall grant or dismiss that request without delay. If, at the time the request is filed, the court is already in a position to decide the case, the court may rule on that request in its judgment or in its order deciding the case.

Section 25 is the procedural gateway for the protective and enforcement measures set out in Book 4 of the Code, including interim measures to protect a party's rights during litigation and measures used to enforce a judgment or order. Its core commands are that the court must act without delay and that, where the case is ripe, the court may fold its ruling on the motion into the final judgment. It does not require the court to hold an inquiry before ruling; the court may decide on the motion where the facts on record are sufficient.
Why this matters in practice
For litigants, Section 25 is how you obtain urgent protection, such as a measure to preserve the status quo during the case, and how you set enforcement measures in motion after judgment. Because the court need not hold an inquiry, your motion should stand on its own, with the supporting facts and documents attached so the court can rule at once. A motion to stay execution is a request under Section 25 for a measure to enforce a judgment; Section 25 does not require the court to hold an inquiry first, so the court may rule where the facts of the case are sufficient.
The Court treated the defendant's motion to stay execution as a Section 25 request for a measure to enforce the judgment and held that Section 25 does not require an inquiry before the court grants or refuses it. Where the court finds the facts of the case sufficient to decide the motion, it need not hold an inquiry.

Under Section 25 a court may issue an interim protective order, such as prohibiting a party from continuing to work disputed land, in order to protect the interests of the parties while the case is pending.
Finding sufficient and necessary grounds to protect the parties' interests, the trial court issued an order under Section 25 prohibiting the plaintiff from tapping rubber in the disputed plantation while the case was pending, and the higher courts upheld the order.
