Article 67: Required contents of pleadings

เมื่อประมวลกฎหมายนี้หรือกฎหมายอื่นบัญญัติว่า เอกสารใดจะต้องส่งให้แก่คู่ความฝ่ายใดฝ่ายหนึ่งหรือบุคคลที่เกี่ยวข้อง (เช่น คำคู่ความที่ทำโดยคำฟ้อง คำให้การ หรือคำร้อง หรือคำขอโดยทำเป็นคำร้อง หมายเรียกหรือหมายอื่น ๆ สำเนาคำแถลงการณ์ หรือสำเนาพยานเอกสาร ฯลฯ) เอกสารนั้นต้องทำขึ้นให้ปรากฏข้อความแน่ชัดถึงตัวบุคคลและมีรายการต่อไปนี้
(๑) ชื่อศาลที่จะรับคำฟ้อง หรือถ้าคดีอยู่ในระหว่างพิจารณา ชื่อของศาลนั้นและเลขหมายคดี

(๕) วัน เดือน ปี ของคำคู่ความ หรือเอกสารและลายมือชื่อของเจ้าพนักงาน คู่ความ หรือบุคคลซึ่งเป็นผู้ยื่นหรือเป็นผู้ส่งในการยื่นหรือส่งคำคู่ความ หรือเอกสารอื่นใดอันจะต้องทำตามแบบพิมพ์ที่จัดไว้ เจ้าพนักงาน คู่ความ หรือบุคคลผู้เกี่ยวข้องจะต้องใช้กระดาษแบบพิมพ์นั้น ส่วนราคากระดาษแบบพิมพ์นั้นให้เรียกตามที่รัฐมนตรีว่าการกระทรวงยุติธรรมจะได้กำหนดไว้เพื่อประโยชน์แห่งประมวลกฎหมายนี้ ให้เรียกนิติบุคคลตามชื่อหรือตามชื่อที่จดทะเบียนและภูมิลำเนาหรือสำนักทำการงานของนิติบุคคลนั้น ให้ถือเอาสำนักงานหรือสำนักงานแห่งใหญ่ซึ่งอยู่ภายในเขตศาลที่จะยื่นฟ้องคดีหรือที่คดีนั้นอยู่ในระหว่างพิจารณา

English translation

When this Code or another law provides that a document is to be served on one party or on a related person (for example, a pleading made as a plaint, an answer, or a motion, or a request made in the form of a motion, a summons or other writ, a copy of a statement, or a copy of documentary evidence, and so on), that document must be made so as to show clearly the identity of the persons and must contain the following particulars:
(1) the name of the court that is to receive the plaint, or, if the case is under trial, the name of that court and the case number;
(2) the names of the parties to the case;
(3) the name of the party or person who is to receive the pleading or document;
(4) the substance and, if necessary, the reasons of the pleading or document;
(5) the day, month, and year of the pleading or document and the signature of the official, party, or person who files or serves it.
In filing or serving a pleading or any other document that must follow a prescribed printed form, the official, party, or related person must use that printed form, and the price of the printed form shall be charged as the Minister of Justice may fix. For the purposes of this Code, a juristic person shall be called by its name or its registered name and by its domicile or place of business, and the office or head office situated within the jurisdiction of the court where the case is to be filed or is under trial shall be taken as such.

Section 67 opens Title 4 on the filing and service of pleadings and documents by setting the minimum form that any served document must take. The five itemized particulars, especially item (5) requiring the day, month, year, and signature, are treated as conditions of a complete pleading. A plaint that omits the name and signature of the person who drafted and typed it is incomplete under Section 67(5), and the trial court may order it returned or corrected under Section 18 paragraph two. The provision also fixes how juristic persons are to be named and located, tying the reference to the court that has jurisdiction over the case.

Why this matters in practice

For a litigant this is a checklist: a pleading missing the required particulars can be sent back or, in the worst case, dismissed as incomplete. The signature and drafter details in item (5) are a common trap, because only a party in person or a licensed lawyer may sign as the drafter of a pleading; a signature by someone without that authority makes the step improper. Have a qualified Thai lawyer check the form of your court documents before they go in.

    A plaint that lacks a statement of the drafter and typist and the drafter's signature is incomplete under Section 67(5), which the court has power to order returned or corrected under Section 18 paragraph two.

    The defendant argued the plaint showed no drafter or typist. The court agreed the omission made the plaint incomplete under Section 67(5), correctable under Section 18 paragraph two, but noted the trial court had not so ordered and the case had already run to the Supreme Court, and the record showed the appointed lawyer had later signed as drafter of other filings.

  2. Arrêt de la Cour suprême n° 470/2562 (2019)

    Where a plaintiff sues without appointing an advocate, signs the plaint as plaintiff and is also named and signs as the person who wrote or typed it, he may fairly be taken to be the drafter. His failure to sign in the drafter's box does not go so far as to affect public order such that the plaint must be dismissed.

    When the plaintiff filed the plaint he had not appointed an advocate; he signed as plaintiff, and his name and signature also appeared as the person who wrote or typed it. The Supreme Court held he could fairly be taken to be the drafter, so his failure to sign in the drafter's box did not go so far as to affect public order such that the plaint had to be dismissed. It therefore disagreed with the Court of Appeal Region 2's dismissal of the plaint and allowed the plaintiff's appeal.

  3. Arrêt de la Cour suprême n° 1820/2560 (2017)

    Where the person who signed as drafter of a pleading was not a lawyer, that person had no authority to sign, so the filing was an improper proceeding under Section 67(5), and it is not a mere defect of capacity or wording correctable under Section 27.

    The signer in the drafter box was shown not to be an attorney, the license field being marked only with a dash. The court held he had no authority to sign as drafter, so the filing was improper under Section 67(5) rather than a curable irregularity under Section 27, and it declined to admit the appeal.
