Article 90: Serving copies of documentary evidence

ให้คู่ความฝ่ายที่อ้างอิงเอกสารเป็นพยานหลักฐานเพื่อสนับสนุนข้ออ้างหรือข้อเถียงของตนตามมาตรา ๘๘ วรรคหนึ่ง ยื่นต่อศาลและส่งให้คู่ความฝ่ายอื่นซึ่งสำเนาเอกสารนั้นก่อนวันสืบพยานไม่น้อยกว่าเจ็ดวันในกรณีที่คู่ความฝ่ายใดยื่นคำแถลงหรือคำร้องขออนุญาตอ้างอิงเอกสารเป็นพยานหลักฐานตามมาตรา ๘๘ วรรคสองหรือวรรคสาม ให้ยื่นต่อศาลและส่งให้คู่ความฝ่ายอื่นซึ่งสำเนาเอกสารนั้นพร้อมกับการยื่นคำแถลงหรือคำร้องดังกล่าว เว้นแต่ศาลจะอนุญาตให้ยื่นสำเนาเอกสารภายหลังเมื่อมีเหตุอันสมควรคู่ความฝ่ายที่อ้างอิงพยานหลักฐานไม่ต้องยื่นสำเนาเอกสารต่อศาล และไม่ต้องส่งสำเนาเอกสารให้คู่ความฝ่ายอื่นในกรณีดังต่อไปนี้
(๑) เมื่อคู่ความฝ่ายใดอ้างอิงเอกสารเป็นชุดซึ่งคู่ความฝ่ายอื่นทราบดีอยู่แล้วหรือสามารถตรวจตราให้ทราบได้โดยง่ายถึงความมีอยู่และความแท้จริงแห่งเอกสารนั้น เช่น จดหมายโต้ตอบระหว่างคู่ความในคดี หรือสมุดบัญชีการค้า และสมุดบัญชีของธนาคารหรือเอกสารในสำนวนคดีเรื่องอื่น
(๒) เมื่อคู่ความฝ่ายใดอ้างอิงเอกสารฉบับเดียวหรือหลายฉบับที่อยู่ในความครอบครองของคู่ความฝ่ายอื่นหรือของบุคคลภายนอก
(๓) ถ้าการคัดสำเนาเอกสารจะทำให้กระบวนพิจารณาล่าช้าเป็นที่เสื่อมเสียแก่คู่ความซึ่งอ้างอิงเอกสารนั้น หรือมีเหตุผลแสดงว่าไม่อาจคัดสำเนาเอกสารให้เสร็จภายในกำหนดเวลาที่ให้ยื่นสำเนาเอกสารนั้นกรณีตาม
(๑) หรือ
(๓) ให้คู่ความฝ่ายที่อ้างอิงเอกสารยื่นคำขอฝ่ายเดียวโดยทำเป็นคำร้องต่อศาล ขออนุญาตงดการยื่นสำเนาเอกสารนั้นและขอยื่นต้นฉบับเอกสารแทน เพื่อให้ศาลหรือคู่ความฝ่ายอื่นตรวจดูตามเงื่อนไขที่ศาลเห็นสมควรกำหนดกรณีตาม
(๒) ให้คู่ความฝ่ายที่อ้างอิงเอกสารขอให้ศาลมีคำสั่งเรียกเอกสารนั้นมาจากผู้ครอบครองตามมาตรา ๑๒๓ โดยต้องยื่นคำร้องต่อศาลภายในกำหนดเวลาตามวรรคหนึ่งหรือวรรคสอง แล้วแต่กรณี และให้คู่ความฝ่ายนั้นมีหน้าที่ติดตามเพื่อให้ได้เอกสารดังกล่าวมาภายในเวลาที่ศาลกำหนด
English translation
A party which relies on a document as evidence in support of its allegation or defense under Section 88 paragraph one shall submit it to the court and serve on the other parties a copy of that document not less than seven days before the date of taking evidence.
Where any party submits a statement or a motion requesting leave to rely on a document as evidence under Section 88 paragraph two or paragraph three, it shall submit to the court and serve on the other parties a copy of that document together with the submission of such statement or motion, unless the court, upon reasonable cause, permits the copy to be submitted later.
A party relying on evidence need not submit a copy of the document to the court, and need not serve a copy on the other parties, in the following cases:
(1) where a party relies on a set of documents which the other parties already know well, or can easily ascertain, as to the existence and authenticity of those documents, such as correspondence between the parties in the case, trade account books, bank account books, or documents in the file of another case;
(2) where a party relies on one or more documents which are in the possession of the other parties or of a third person;
(3) where making copies of the documents would delay the proceedings to the detriment of the party relying on those documents, or where there is reason to show that the copies cannot be completed within the time allowed for submitting them.
In the case of (1) or (3), the party relying on the document shall submit an ex parte application, made as a motion to the court, requesting leave to dispense with submitting the copy and to submit the original document instead, for the court or the other parties to examine, on the conditions the court thinks fit to prescribe.
In the case of (2), the party relying on the document shall request the court to issue an order summoning the document from the person in possession under Section 123, by submitting a motion to the court within the time under paragraph one or paragraph two, as the case may be, and that party has the duty to follow up in order to obtain the document within the time set by the court.

Section 90 is the disclosure companion to Section 88: once a document is listed, its copy must actually reach the court and the opponent, in the ordinary case not less than seven days before the evidence date, so that no party is ambushed by paper it has not seen. Paragraphs three onward carve out practical exceptions, including documents already known to the opponent, documents held by the opponent or a third party, and situations where copying would cause delay, each routed either through an ex parte application to tender the original or, for documents in another's possession, through a summons under Section 123. Failure to serve a copy can make the document inadmissible, subject to waiver rules under Sections 93 and 125.
Why this matters in practice
Two mistakes recur here: serving a document copy late, and assuming an exception applies without filing the required motion. If the key document is in your opponent's hands, do not simply attach a copy; list it and ask the court to summon the original under Section 123, then chase it down within the court's deadline. If you receive a late or unserved document from the other side, decide at once whether to object, because silence at trial can be treated as consent.

Where the original of a document is in the opponent's possession, the party relying on it need not serve a copy under the ordinary rule; it may list the document and ask the court to summon the original from the possessor, and the copy is then admissible.
The Supreme Court rejected the argument that a copy of a debenture certificate was inadmissible for want of service under Section 90, because the plaintiff had listed it and asked the court to summon the original from the defendant who held it.

An objection that a copy of a listed document was not served under Section 90 is waived if it is not raised at the trial court when the document is adduced, and cannot be raised for the first time on appeal.
The court held that where the objector did not challenge a copy of the will at trial as one that had to be served under Section 90, it could not raise the point on appeal.

A document that a party has neither listed in its list of witnesses under section 88 nor served a copy of under section 90 may still be admitted in the interest of justice under section 87(2), together with the party's other evidence, where the other side has had ample time and opportunity to examine and answer it.
The plaint alleged that defendant 1 had borrowed 106,000,000 baht and had mortgaged two title deeds to secure the loan, attaching copies of both the loan agreement and the mortgage. Since the mortgage instrument was made before a land official, recorded that the mortgage secured a loan of that amount, and provided that it was also to serve as evidence of the loan, it was itself evidence of the borrowing on which the plaintiff could rely, so giving judgment on it was not going beyond the plaint. On the receipt which the plaintiff had neither listed under section 88 nor served under section 90, the Supreme Court held there was reason to admit it in the interest of justice under section 87(2), together with the plaintiff's other evidence.
