Article 93: Original document rule and exceptions

การอ้างเอกสารเป็นพยานหลักฐานให้ยอมรับฟังได้เฉพาะต้นฉบับเอกสารเท่านั้น เว้นแต่
(๑) เมื่อคู่ความที่เกี่ยวข้องทุกฝ่ายตกลงกันว่าสำเนาเอกสารนั้นถูกต้องแล้วให้ศาลยอมรับฟังสำเนาเช่นว่านั้นเป็นพยานหลักฐาน
(๒) ถ้าต้นฉบับเอกสารนำมาไม่ได้ เพราะถูกทำลายโดยเหตุสุดวิสัย หรือสูญหาย หรือไม่สามารถนำมาได้โดยประการอื่น อันมิใช่เกิดจากพฤติการณ์ที่ผู้อ้างต้องรับผิดชอบ หรือเมื่อศาลเห็นว่าเป็นกรณีจำเป็นและเพื่อประโยชน์แห่งความยุติธรรมที่จะต้องสืบสำเนาเอกสารหรือพยานบุคคลแทนต้นฉบับเอกสารที่นำมาไม่ได้นั้น ศาลจะอนุญาตให้นำสำเนาหรือพยานบุคคลมาสืบก็ได้
(๓) ต้นฉบับเอกสารที่อยู่ในความอารักขาหรือในความควบคุมของทางราชการนั้นจะนำมาแสดงได้ต่อเมื่อได้รับอนุญาตจากทางราชการที่เกี่ยวข้องเสียก่อน อนึ่ง สำเนาเอกสารซึ่งผู้มีอำนาจหน้าที่ได้รับรองว่าถูกต้องแล้ว ให้ถือว่าเป็นอันเพียงพอในการที่จะนำมาแสดง เว้นแต่ศาลจะได้กำหนดเป็นอย่างอื่น
(๔) เมื่อคู่ความฝ่ายที่ถูกคู่ความอีกฝ่ายหนึ่งอ้างอิงเอกสารมาเป็นพยานหลักฐานยันตนมิได้คัดค้านการนำเอกสารนั้นมาสืบตามมาตรา ๑๒๕ ให้ศาลรับฟังสำเนาเอกสารเช่นว่านั้นเป็นพยานหลักฐานได้ แต่ทั้งนี้ ไม่ตัดอำนาจศาลตามมาตรา ๑๒๕ วรรคสาม
English translation
Reliance on a document as evidence is admissible only for the original document, except:
(1) when all parties concerned agree that a copy of the document is correct, the court shall admit such copy as evidence;
(2) if the original document cannot be produced because it has been destroyed by force majeure, or lost, or cannot be produced by other means not arising from circumstances for which the party relying on it is responsible, or when the court is of the opinion that it is a case of necessity and in the interest of justice to take a copy of the document or oral evidence in place of the original that cannot be produced, the court may permit a copy or oral evidence to be adduced;
(3) an original document that is in the custody or under the control of a government authority may be produced only after permission has been obtained from the relevant government authority; moreover, a copy of a document certified as correct by a person having authority and duty shall be deemed sufficient for production, unless the court prescribes otherwise;
(4) when the party against whom the other party relies on a document as evidence has not objected to the adducing of that document under Section 125, the court shall admit such copy of the document as evidence; provided, however, that this does not affect the court's power under Section 125 paragraph three.

Section 93 states Thailand's best-evidence rule for documents: the original governs, and copies or oral substitutes are admissible only within four exceptions. Exception (1) rests on agreement, (2) on impossibility or the interest of justice, (3) on official custody with certified copies treated as sufficient, and (4) on the opponent's failure to object under Section 125. Exception (4) is the most litigated in practice, because a party that does not challenge a copy when it is adduced usually cannot complain later. The section works closely with Section 94 on when oral evidence may not vary documents, and with Sections 123 and 125 on producing and objecting to documents.
Why this matters in practice
If you must rely on a copy, plan for it: get the other side to agree it is correct, or be ready to prove the original was lost or destroyed without your fault. The most common and costly slip is silence, if the other side puts in a copy and you do not object when it is adduced, you can lose the right to challenge it under exception (4). Keep originals safe, and object clearly and on the record if a copy is tendered where the original should be.

Under Section 93(2), the court may admit a copy of a document in place of the original where it finds this a case of necessity and in the interest of justice.
The Supreme Court held that by completing its inquiry and allowing substitution of the creditor, the trial court had treated the matter as necessary and just, so a copy of the asset purchase agreement was admissible under Section 93(2).

Under Section 93(4) read with Section 125, where a party does not object at trial that a document is a copy rather than the original, the court may admit the copy as evidence.
The Supreme Court held that because the plaintiff did not object under Section 125 when the copy was adduced against him, the copy was admissible under Section 93(4).

The Supreme Court held that because the plaintiff did not object at trial to the road-permit documents, they were admissible under Section 93(4) with Section 125 despite no official certifying them.

Puis-je utiliser une copie d'un document au lieu de l'original devant un tribunal ?
Uniquement dans les exceptions prévues à l'article 93, par exemple lorsque toutes les parties conviennent que la copie est correcte, que l'original est perdu ou détruit sans votre faute, qu'il est détenu par une autorité gouvernementale ou que l'autre partie ne s'y oppose pas au procès.
