ในกรณีผิดสัญญาประกันต่อศาล ศาลมีอำนาจสั่งบังคับตามสัญญาประกันหรือตามที่ศาลเห็นสมควรโดยมิต้องฟ้อง ทั้งนี้ ศาลอาจสั่งงดการบังคับตามสัญญาประกันหรือลดจำนวนเงินที่ต้องใช้ตามสัญญาประกันก็ได้ โดยคำนึงถึงความพยายามของผู้ประกันในการติดตามตัวผู้ต้องหาหรือจำเลยที่หลบหนี รวมทั้งความเสียหายที่เกิดขึ้นว่ามีมากน้อยเพียงใดประกอบด้วย และเมื่อศาลสั่งประการใดแล้วฝ่ายผู้ถูกบังคับตามสัญญาประกันหรือพนักงานอัยการมีอำนาจอุทธรณ์ได้ คำวินิจฉัยของศาลอุทธรณ์ให้เป็นที่สุดเงินสดหรือหลักทรัพย์อื่นที่นำมาวางต่อศาลเพื่อเป็นหลักประกันตามมาตรา ๑๑๔ ไม่อยู่ในข่ายที่จะถูกยึดหรืออายัดเพื่อชำระหนี้ให้แก่เจ้าหนี้อื่นจนกว่าความรับผิดตามสัญญาประกันจะระงับสิ้นไป เว้นแต่ศาลเห็นว่าหนี้ของเจ้าหนี้นั้นมิได้เกิดจากการฉ้อฉลและมีคำสั่งให้ปล่อยทรัพย์ดังกล่าวในกรณีที่จำเป็นต้องมีการบังคับคดีเพราะผิดสัญญาประกันตามวรรคหนึ่ง ให้ศาลมีอำนาจออกหมายบังคับคดีหรือคำสั่งอื่นใดเพื่อบังคับเอาแก่ทรัพย์สินของบุคคลซึ่งต้องรับผิดตามสัญญาประกันได้เสมือนว่าเป็นลูกหนี้ตามคำพิพากษา โดยให้เจ้าพนักงานศาลที่ได้รับแต่งตั้งและพนักงานอัยการเป็นผู้มีอำนาจหน้าที่ในการบังคับตามสัญญาประกัน และให้เจ้าพนักงานบังคับคดี กรมบังคับคดี มีอำนาจหน้าที่ยึดหรืออายัดทรัพย์สินของผู้ประกันและขายทอดตลาดตามที่ได้รับแจ้งจากศาล หรือพนักงานอัยการ และถ้าจะต้องขายทรัพย์สินที่วางเป็นหลักประกันไว้ต่อศาล เมื่อศาลส่งทรัพย์สินหรือหนังสือสำคัญสำหรับทรัพย์สินนั้นไปยังเจ้าพนักงานบังคับคดี กรมบังคับคดี ให้ถือว่าได้มีการยึดทรัพย์สินดังกล่าวแล้ว ทั้งนี้ มิให้หน่วยงานของรัฐเรียกค่าฤชาธรรมเนียมหรือค่าใช้จ่ายจากผู้ดำเนินการบังคับคดีการบังคับคดีตามมาตรานี้ ให้ปฏิบัติตามประมวลกฎหมายวิธีพิจารณาความแพ่งโดยอนุโลม เว้นแต่ประธานศาลฎีกาโดยความเห็นชอบของที่ประชุมใหญ่ศาลฎีกาจะออกข้อบังคับกำหนดไว้เป็นอย่างอื่น ข้อบังคับนั้นเมื่อประกาศในราชกิจจานุเบกษาแล้วให้ใช้บังคับได้นไปยังเจ้าพนักงานบังคับคดี กรมบังคับคดี ให้ถือว่าได้มีการยึดทรัพย์สินดังกล่าวแล้ว ทั้งนี้ มิให้หน่วยงานของรัฐเรียกค่าฤชาธรรมเนียมหรือค่าใช้จ่ายจากผู้ดำเนินการบังคับคดี

English translation

Where there is a breach of a bail bond given to the court, the court has the power to order enforcement of the bond or as the court sees fit, without the need to file a lawsuit. In doing so, the court may order a stay of enforcement of the bond or reduce the amount payable under the bond, taking into account the surety's efforts to trace the accused or defendant who has absconded, together with how much or how little damage has occurred. Once the court has issued any order, the party against whom the bond is enforced or the public prosecutor has the right to appeal, and the decision of the Court of Appeal shall be final. Cash or other securities deposited with the court as security under Section 114 shall not be subject to seizure or attachment to satisfy debts owed to other creditors until liability under the bond has been extinguished, unless the court is of the opinion that the creditor's debt did not arise from fraud and orders the release of such property. Where enforcement is necessary because of a breach of the bond under paragraph one, the court has the power to issue a writ of execution or any other order to enforce against the property of the person liable under the bond as if that person were a judgment debtor. The court officer so appointed and the public prosecutor shall have the authority and duty to enforce the bond, and the execution officer of the Legal Execution Department shall have the authority and duty to seize or attach the surety's property and sell it by public auction as notified by the court or the public prosecutor. Where property deposited as security with the court must be sold, once the court sends the property or the title documents for that property to the execution officer of the Legal Execution Department, the property shall be deemed to have been seized. In this regard, no state agency shall charge court fees or expenses from the person carrying out the execution. Execution under this section shall follow the Civil Procedure Code mutatis mutandis, unless the President of the Supreme Court, with the approval of the plenary session of the Supreme Court, issues regulations providing otherwise. Such regulations shall take effect upon publication in the Government Gazette.

Remember the Court of Appeal's ruling on the amount is final, so there is no Supreme Court review. Before pledging assets as bail, it is worth getting advice from a Thai lawyer on your exposure.

  1. Arrêt de la Cour suprême n° 3245/2568 (2025)

    Once the Court of Appeal affirms the trial court's order reducing a bail forfeiture, that decision is final under Section 119 paragraph one and the surety cannot pursue a further appeal to the Supreme Court.

    The surety was fined 283,500 baht after the forfeiture was reduced. The Supreme Court held that because the Court of Appeal had affirmed the reduced fine, its judgment was final under Section 119 paragraph one, so the trial court's acceptance of the surety's further appeal was improper and would not be considered.

    Where the Court of Appeal affirms the trial court's dismissal of a surety's petition connected with bond enforcement, that ruling is final under Section 119 paragraph one and no further appeal to the Supreme Court lies.

    A surety sought a refund of money paid, but the Court of Appeal (Region 5) affirmed dismissal of the petition. The Supreme Court held that ruling was final under Section 119 paragraph one and declined to consider the surety's improperly accepted appeal.

  3. Arrêt de la Cour suprême n° 4419/2560 (2017)

    Cash or securities deposited under Section 114 as bail security are protected: while the case is pending the creditor is not a secured creditor, and Section 119 paragraph two (added by Amendment Act No. 30, B.E. 2558) shields the deposit from other creditors until bond liability ends.

    The Supreme Court held the creditor did not hold secured-creditor status under the Bankruptcy Act because the deposit was held pending performance of the bond. It noted the newly added Section 119 paragraph two, which bars seizure of Section 114 security by other creditors until bond liability is extinguished, unless the court finds the debt non-fraudulent and orders release.

  4. Arrêt de la Cour suprême n° 10072/2558 (2015)

    Enforcement of a bail bond forfeited for breach before the court under section 119 follows from the grant of provisional release and the surety's failure to produce the accused, and is a criminal proceeding in its own right. The surety's duty is to bring the accused or the defendant to court by the appointed time, and for as long as that is not done the surety remains in breach. If the surety takes steps to produce the person within the criminal limitation period the court may reduce or remit the fine according to the circumstances, even where the person is produced more than ten years after the forfeiture order. It follows that the officer may apply to enforce the forfeiture order beyond ten years from the order without applying to extend the enforcement period, and while that right of enforcement subsists there is no other ground under section 118 for returning the security or the deposit.

    The trial court had released the second defendant provisionally on a bond valued at 600,000 baht. The sureties failed to produce him on 1 August 2001 and were fined under the bond, and they were notified to pay within fifteen days. In April 2014 they applied to have the security and a 500,000 baht deposit returned, arguing that the judgment creditor's ten-year period for enforcing the forfeiture had expired without any seizure or attachment. The Supreme Court held that enforcement of a forfeited bail bond under section 119 is a criminal proceeding, that the surety's duty to produce the accused continues so that the surety remains in breach until it is performed, and that a surety who produces the person within the criminal limitation period may have the fine reduced or remitted even after more than ten years. The officer could therefore still apply to enforce the forfeiture order beyond ten years without seeking an extension, and since that right subsisted there was no other ground under section 118 to return the security or the deposit. The Court of Appeal Region 2 was reversed and the sureties' application dismissed.
