เพื่อให้การพิจารณาเป็นไปด้วยความรวดเร็ว
ต่อเนื่อง และเป็นธรรมในคดีที่จำเลยไม่ให้การหรือให้การปฏิเสธ
เมื่อคู่ความฝ่ายใดฝ่ายหนึ่งร้องขอหรือศาลเห็นสมควรศาลอาจกำหนดให้มีวันตรวจพยานหลักฐานก่อนกำหนดวันนัดสืบพยานก็ได้
โดยแจ้งให้คู่ความทราบล่วงหน้าไม่น้อยกว่าสิบสี่วันก่อนวันตรวจพยานหลักฐานตามวรรคหนึ่งไม่น้อยกว่าเจ็ดวัน
ให้คู่ความยื่นบัญชีระบุพยานต่อศาลพร้อมสำเนาในจำนวนที่เพียงพอ

English translation
In order that the trial may proceed speedily, continuously, and fairly, in a case in which the defendant does not plead or pleads not guilty, on the application of either party or when the court considers it appropriate, the court may fix a date for the examination of evidence before fixing the date for taking evidence, giving the parties advance notice of not less than fourteen days. Not less than seven days before the evidence-examination date under paragraph one, the parties shall submit to the court a list of witnesses together with sufficient copies for the other parties to collect from the court officer; and if any party wishes to submit an additional list of witnesses, it shall be submitted to the court before the examination of evidence is concluded. Submission of an additional list of witnesses after the period under paragraph two has passed may be done only with the court's permission, when the applicant shows reasonable cause that it could not have known of that evidence, or where it is necessary in the interest of justice or to give the defendant a full opportunity to contest the case. If any documentary or material evidence is in the possession of a third person, a party wishing to rely on it shall apply to the court to order that evidence produced from the possessor by filing an application together with the list of witnesses, so as to obtain that documentary or material evidence before the evidence-examination date or the date the court fixes.

Its core discipline is timing: at least fourteen days' notice of the evidence-examination date, and the list of witnesses due at least seven days before it, with copies for the other side. Late or additional witness lists are allowed only with the court's permission on reasonable cause, in the interest of justice, or to give the defendant a full opportunity to defend, which keeps the process fair without inviting surprise. It also provides the mechanism to compel documents or objects held by third parties, and it works directly with Section 173/2, which governs what happens on the examination day itself.
Why this matters in practice
The seven-day deadline for the witness list is unforgiving: a party that misses it generally loses the right to call those witnesses, and courts have refused to admit evidence listed too late without a proper application to extend. Litigants should treat the evidence-examination stage as the moment to lock in their proof, request third-party documents early by filing with the witness list, and seek permission promptly if new evidence surfaces. Where on the evidence-examination date the prosecutor refuses to examine the evidence and the court then orders the case to go on to the taking of evidence, the court has in effect made a different order because of the nature and necessity of the evidence under Section 173/2, and has cancelled the fixing of an evidence-examination date. The case is then governed by Section 240 paragraph one, under which a party relying on a document in its possession must file it with the court not less than fifteen days before the date for taking evidence.
The defendant argued that the prosecutor's list of witnesses did not meet the seven-day rule in Section 173/1 paragraph two, so the evidence could not be relied on. The Supreme Court disagreed. On the evidence-examination date the prosecutor had refused to examine the evidence and the court had ordered the case to proceed to the taking of evidence, which amounted to an order under Section 173/2 cancelling the evidence-examination date. Section 173/1's deadline therefore did not govern, Section 240 paragraph one did, and the courts below had power to take and rely on the evidence.

Quand une partie doit-elle déposer sa liste de témoins ?
Conformément à l'article 173/1, la liste des témoins doit être déposée au moins sept jours avant la date de l'audience, une copie devant être remise à la partie adverse. Toute liste supplémentaire ou tardive nécessite l'autorisation du tribunal pour un motif valable.
