If an offense punishable under Thai law was committed outside the Kingdom of Thailand, the Attorney General or the person acting in that capacity shall be the responsible inquiry official, or may assign that duty to any public prosecutor or inquiry official to be responsible for conducting the inquiry in his stead. In a case where the Attorney General or the person acting in that capacity assigns any inquiry official to be responsible for conducting the inquiry, the Attorney General or the person acting in that capacity may also assign any public prosecutor to conduct the inquiry jointly with the inquiry official. A public prosecutor assigned to be the responsible inquiry official, or to conduct the inquiry jointly with the inquiry official, shall have the same powers and duties in conducting the inquiry as an inquiry official, together with all other powers and duties that the law provides to be those of a public prosecutor. Where a public prosecutor conducts the inquiry jointly with the inquiry official, the inquiry official shall comply with the orders and advice of the public prosecutor in matters relating to the collection of evidence. In case of necessity, the following inquiry officials shall have the power to conduct the inquiry while awaiting an order from the Attorney General or the person acting in that capacity: (1) the inquiry official within whose jurisdiction the alleged offender was arrested; (2) the inquiry official to whom the government of another country or the injured person has made a complaint requesting punishment of the alleged offender. When the public prosecutor or the inquiry official responsible for the inquiry, as the case may be, is of the opinion that the inquiry is complete, an opinion shall be made under Section 140, Section 141, or Section 142 and forwarded together with the case file to the Attorney General or the person acting in that capacity.

Section 20 carves out a special regime for offenses that carry Thai penalties but occur outside the Kingdom. Because no ordinary Thai locality is the natural place of the offense, the Code centralizes responsibility in the Attorney General, who may act personally or assign a prosecutor or inquiry official, and may pair a prosecutor with the inquiry official; in a joint inquiry the inquiry official must follow the prosecutor's directions on gathering evidence. A necessity valve lets the station of arrest or the station that received the complaint act in the interim while awaiting the Attorney General's order, and the completed file returns to the Attorney General for an opinion under Sections 140 to 142. The provision only bites where the offense was truly committed abroad; if the Penal Code deems the offense committed within the Kingdom, Section 20 does not apply.

For cross-border cases this is a jurisdiction trap. If the offense was committed abroad but the inquiry did not run through the Attorney General as required by Section 20, the inquiry can be defective and the prosecution challenged. But the threshold question is whether the act was really committed outside the Kingdom: under the Penal Code, an act with only a part, a preparation, or an attempt abroad may be deemed committed within Thailand, in which case Section 20 does not apply and ordinary jurisdiction rules govern. Anyone facing a charge with an overseas element should have a licensed Thai lawyer check whether the correct authority conducted the inquiry.

Section 20 applies only to offenses committed wholly outside the Kingdom; where only a part, preparation, or attempt occurred abroad and the Penal Code deems the offense committed within the Kingdom, Section 20 paragraph one does not apply.
Even assuming the deception of the injured party occurred abroad, the Court held it was only preparation, attempt, or a part of the act, which the Penal Code deems committed within the Kingdom. Section 20 paragraph one therefore did not apply, the inquiry was lawful, and the prosecutor had power to prosecute.

Where an offense is committed outside the Kingdom, the Attorney General is the responsible inquiry official under Section 20 and has power to assign that responsibility to a prosecutor or inquiry official to conduct the inquiry in his stead.
In a case charging the cross-border import of protected rhinoceros horn, the Court examined whether the Attorney General was the responsible inquiry official with power to delegate the inquiry under Section 20, and confirmed that the section places responsibility with the Attorney General, who may assign it to a prosecutor or inquiry official.

The general rule that an offense committed abroad must be inquired into with the Attorney General as responsible official under Section 20 may be displaced by a special statute, such as the organic law giving the National Anti-Corruption Commission its own investigative authority.
The defendant argued that, because the conduct occurred abroad, the inquiry had to run through the Attorney General under Section 20, so the plaintiff who filed personally lacked authority. The Court addressed this against the special anti-corruption law, under which the NACC has its own power to conduct the inquiry.
