This provision extends the reach of any statutory restriction limiting a Dika to questions of law. Its purpose is to prevent parties or third persons involved in a case, such as a claimant to seized property or a joined plaintiff, from evading the fact-question bar simply because they are not the principal accused or prosecutor. It works alongside the substantive bars in Sections 218, 219, and 220, which specify when only law questions may be raised, and it should be read with Section 221, the narrow safety valve that allows a certified Dika even in barred cases.     A Dika contesting the Court of Appeal judgment on whether an appeal was barred under Section 193 bis is a question of law, which is not prohibited by Sections 217 to 221 and may therefore be filed under Section 216.

    The Court of First Instance refused the defendant's Dika. On the defendant's petition, the Supreme Court held that the Dika raised a pure question of law, whether the appeal was barred under Section 193 bis, which is not caught by the restrictions in Sections 217 to 221, and ordered the Dika accepted for consideration.
