ก่อนฟ้องคดีต่อศาล
เมื่อมีเหตุอันควรเชื่อได้ว่าพยานบุคคลจะเดินทางออกไปนอกราชอาณาจักร
ไม่มีที่อยู่เป็นหลักแหล่ง
หรือเป็นบุคคลมีถิ่นที่อยู่ห่างไกลจากศาลที่พิจารณาคดีหรือมีเหตุอันควรเชื่อว่าจะมีการยุ่งเหยิงกับพยานนั้นไม่ว่าโดยทางตรงหรือทางอ้อม
หรือมีเหตุจำเป็นอื่นอันเป็นการยากแก่การนำพยานนั้นมาสืบในภายหน้า
พนักงานอัยการโดยตนเองหรือโดยได้รับคำร้องขอจากผู้เสียหายหรือจากพนักงานสอบสวน
จะยื่นคำร้องโดยระบุการกระทำทั้งหลายที่อ้างว่าผู้ต้องหาได้กระทำผิดต่อศาลเพื่อให้ศาลมีคำสั่งให้สืบพยานนั้นไว้ทันทีก็ได้
ถ้ารู้ตัวผู้กระทำความผิด และผู้นั้นถูกควบคุมอยู่ในอำนาจพนักงานสอบสวนหรือพนักงานอัยการ
ให้พนักงานอัยการนำตัวผู้นั้นมาศาล หากถูกควบคุมอยู่ในอำนาจของศาล
ให้ศาลเบิกตัวผู้นั้นมาพิจารณาต่อไป
เมื่อศาลได้รับคำร้องเช่นว่านั้น
ให้ศาลสืบพยานนั้นทันที ในการนี้ ผู้ต้องหาจะซักค้านหรือตั้งทนายความซักค้านพยานนั้นด้วยก็ได้
ในกรณีตามวรรคสอง
ถ้าเป็นกรณีที่ผู้ต้องหานั้นถูกกล่าวหาว่ากระทำความผิดอาญา
ซึ่งหากมีการฟ้องคดีจะเป็นคดีซึ่งศาลจะต้องตั้งทนายความให้
หรือจำเลยมีสิทธิขอให้ศาลตั้งทนายความให้ตามมาตรา ๑๗๓ ก่อนเริ่มสืบพยานดังกล่าว
ให้ศาลถามผู้ต้องหาว่ามีทนายความหรือไม่ ในกรณีที่ศาลต้องตั้งทนายความให้
ถ้าศาลเห็นว่าตั้งทนายความให้ทันก็ให้ตั้งทนายความให้และดำเนินการสืบพยานนั้นทันที
แต่ถ้าศาลเห็นว่าไม่สามารถตั้งทนายความได้ทันหรือผู้ต้องหาไม่อาจตั้งทนายความได้ทัน
ก็ให้ศาลซักถามพยานนั้นให้แทน
คำเบิกความของพยานดังกล่าวให้ศาลอ่านให้พยานฟัง
หากมีตัวผู้ต้องหาอยู่ในศาลด้วยแล้ว
ก็ให้ศาลอ่านคำเบิกความดังกล่าวต่อหน้าผู้ต้องหา
ถ้าต่อมาผู้ต้องหานั้นถูกฟ้องเป็นจำเลยในการกระทำผิดอาญานั้น
ก็ให้รับฟังคำพยานดังกล่าวในการพิจารณาคดีนั้นได้
ในกรณีที่ผู้ต้องหาเห็นว่า
หากตนถูกฟ้องเป็นจำเลยแล้ว
บุคคลซึ่งจำเป็นจะต้องนำมาสืบเป็นพยานของตนจะเดินทางออกไปนอกราชอาณาจักร
ไม่มีที่อยู่เป็นหลักแหล่ง หรือเป็นบุคคลมีถิ่นที่อยู่ห่างไกลจากศาลที่พิจารณาคดี
หรือมีเหตุอันควรเชื่อว่าจะมีการยุ่งเหยิงกับพยานนั้นไม่ว่าโดยทางตรงหรือทางอ้อม
หรือมีเหตุจำเป็นอื่นอันเป็นการยากแก่การนำพยานนั้นมาสืบในภายหน้า
ผู้ต้องหานั้นจะยื่นคำร้องต่อศาลโดยแสดงเหตุผลความจำเป็น
เพื่อให้ศาลมีคำสั่งอนุญาตให้สืบพยานบุคคลนั้นไว้ทันทีก็ได้
เมื่อศาลเห็นสมควร ให้ศาลมีคำสั่งอนุญาตให้สืบพยานนั้นและแจ้งให้พนักงานสอบสวนและพนักงานอัยการที่เกี่ยวข้องทราบ
ในการสืบพยานดังกล่าว
พนักงานอัยการมีสิทธิที่จะซักค้านพยานนั้นได้และให้นำความในวรรคสาม วรรคสี่
และวรรคห้า มาใช้บังคับโดยอนุโลมให้นำบทบัญญัติในมาตรา ๑๗๒ ตรี มาใช้บังคับโดยอนุโลมแก่การสืบพยานที่เป็นเด็กอายุไม่เกินสิบแปดปี
English translation
Before a case is filed with the court, where there is reasonable ground to believe that a witness will travel out of the Kingdom, has no permanent residence, is a person whose residence is far from the court that will try the case, or where there is reasonable ground to believe that the witness will be interfered with, whether directly or indirectly, or where there is any other necessary cause making it difficult to bring that witness to give evidence in the future, the public prosecutor, by himself or on the request of the injured person or of the inquiry official, may file a motion, stating the acts alleged against the accused, asking the court to order that the witness be examined at once. If the offender is known and is held in the custody of the inquiry official or the public prosecutor, the public prosecutor shall bring that person to the court; if held in the custody of the court, the court shall have that person produced for the proceedings. When the court receives such a motion, it shall examine that witness at once; in this connection the accused may cross-examine, or appoint counsel to cross-examine, that witness. In the case under paragraph two, if the accused is charged with a criminal offence for which, were the case prosecuted, the court would be required to appoint counsel or the defendant would have the right to have the court appoint counsel under Section 173, then before beginning to examine that witness the court shall ask the accused whether he has counsel. Where the court must appoint counsel, if the court considers that counsel can be appointed in time, it shall appoint counsel and proceed to examine the witness at once; but if the court considers that counsel cannot be appointed in time, or that the accused cannot appoint counsel in time, the court shall itself examine the witness on his behalf. The court shall read the witness's testimony to the witness, and if the accused is present in court, shall read that testimony in the presence of the accused. If the accused is later prosecuted as the defendant for that criminal offence, that witness's testimony may be admitted in the trial of that case. Where the accused considers that, if he were prosecuted as the defendant, a person he would necessarily need to call as his own witness will travel out of the Kingdom, has no permanent residence, is a person whose residence is far from the court that will try the case, or that there is reasonable ground to believe the witness will be interfered with, whether directly or indirectly, or that there is any other necessary cause making it difficult to bring that witness to give evidence in the future, the accused may file a motion with the court stating the reasons and necessity, asking the court to order that person examined as a witness at once. When the court thinks fit, it shall order the examination of that witness and notify the inquiry official and the public prosecutor concerned. In such examination the public prosecutor has the right to cross-examine that witness, and the provisions of paragraphs three, four, and five shall apply mutatis mutandis. The provisions of Section 172 ter shall apply mutatis mutandis to the examination of a witness who is a child not over eighteen years of age.

Section 237 bis (237 ทวิ) creates a mechanism for preserving oral evidence before a criminal case is even filed, an exception to the usual rule that witnesses testify at trial. It is triggered by grounds showing the witness may become unavailable: departure from Thailand, no permanent residence, remoteness, risk of interference, or other necessity. The prosecutor may invoke it, and paragraph seven extends the same right to the accused to preserve his own defence witnesses. The section carefully protects the accused's fair-trial rights: he may cross-examine, the court must inquire about counsel and appoint or substitute for it under Section 173, the testimony is read back in his presence, and for child witnesses Section 172 ter safeguards apply. Preserved testimony becomes admissible if the person is later prosecuted.
Why this matters in practice
This is a powerful but tightly conditioned tool. For a victim or prosecutor, it can lock in a key witness's account before an offender flees or intimidates them; for an accused, it protects a favourable witness who may disappear. Note the strict limits confirmed by the courts: the section does not authorise detaining a witness to compel their appearance, and skipping the safeguards can render the evidence inadmissible. Section 237 bis allows the inquiry official or prosecutor to move the court to preserve a witness's testimony where there is reason to believe the witness will become unavailable, but it does not authorise detaining the witness; detaining witnesses to secure their evidence infringes personal liberty and amounts to unlawfully obtained evidence.
Officials had detained the six injured persons and a child who were witnesses in order to bring them to testify. The Supreme Court explained that Section 237 bis lets officials move the court to preserve testimony where a witness may become unavailable, but the detention itself infringed the witnesses' liberty in breach of the Constitution and constituted an unlawful means of obtaining evidence.

Where the offender is known and his whereabouts are known, the inquiry official or the prosecutor must notify the accused of the date fixed for the examination of a witness before charge, and counsel must be appointed for him before that examination begins. Where the court did not appoint counsel and did not question the prosecution witness in the manner of questioning on the accused's behalf, the examination does not comply with Section 237 bis and the evidence so taken cannot be relied on, except as hearsay.
The defendant had surrendered to the inquiry official on the day of the offence and been released. The Supreme Court held that although he was not then in custody, the offender was known and his whereabouts were known, so he had to be notified of the date fixed for the pre-charge examination of the witness and counsel had to be appointed for him before it began. The court of first instance did neither, and did not question the prosecution witness on his behalf, so the examination of that witness did not comply with Section 237 bis and could be relied on only as hearsay.

Under Section 237 bis paragraph five, testimony of witnesses given in a related case may be admitted in the trial of a case arising from the same facts, such as where co-offenders were separated into two prosecutions because some were arrested later.
Co-offenders were prosecuted in two separate cases because some were arrested first and the defendant, who had fled, was arrested later; the two cases arose from the same facts. The Supreme Court held that the testimony of the injured person and another witness given in the related case could be admitted in the trial of this case under Section 237 bis paragraph five.
