ผู้ใดลอบฝัง ซ่อนเร้น ย้ายหรือทำลายศพหรือส่วนของศพเพื่อปิดบังการเกิด การตายหรือเหตุแห่งการตาย ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกินสองหมื่นบาท หรือทั้งจำทั้งปรับ หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๔ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]

Whoever secretly buries, conceals, removes, or destroys a corpse or part of a corpse in order to conceal a birth, a death, or the cause of a death shall be liable to imprisonment not exceeding one year, or a fine not exceeding twenty thousand baht, or both.

The elements are an act of secretly burying, concealing, removing or destroying a corpse or part of one, and the purpose of concealing a birth, a death, or the cause of a death. The purpose is essential: moving a body for a legitimate reason, or without that concealing intent, is outside the section. The penalty is modest, up to one year, because the section protects the integrity of the record rather than any person, and in practice it is charged alongside far heavier offences where a death is being covered up.
