มาตรา 221 เป็นบทเพิ่มโทษ มิใช่ฐานความผิดใหม่ ใช้เมื่อการกระทำพื้นฐานเป็นความผิดการทำให้เกิดระเบิดตามมาตรา 220 และระเบิดนั้นเป็นเหตุให้เกิดอันตรายแก่ทรัพย์ประเภทที่ระบุไว้ในมาตรา 218 เช่น โรงเรือนและสิ่งปลูกสร้างที่มีโทษหนัก เมื่อเข้าเงื่อนไข การกำหนดโทษจะเลื่อนจากอัตรามาตรา 220 ขึ้นเป็นอัตราตามมาตรา 218 ที่หนักกว่ามาก โจทก์ต้องนำสืบทั้งการทำให้เกิดระเบิดตามมาตรา 220 ที่สำเร็จ และการที่ทรัพย์ตามมาตรา 218 ตกอยู่ในอันตราย
