ในกรณีที่ผู้ต้องโทษปรับไม่ชำระค่าปรับภายในกำหนดเวลาตามมาตรา ๒๙ วรรคหนึ่ง ให้ศาลมีอำนาจออกหมายบังคับคดีเพื่อยึดทรัพย์สินหรืออายัดสิทธิเรียกร้องในทรัพย์สินของผู้นั้นเพื่อใช้ค่าปรับ การบังคับคดีตามวรรคหนึ่ง ให้นำประมวลกฎหมายวิธีพิจารณาความแพ่งมาใช้บังคับโดยอนุโลม โดยให้เจ้าพนักงานศาลที่ได้รับแต่งตั้งและพนักงานอัยการเป็นผู้มีอำนาจหน้าที่ในการดำเนินการบังคับคดีและให้เจ้าพนักงานบังคับคดีมีอำนาจหน้าที่ยึดทรัพย์สินหรืออายัดสิทธิเรียกร้องในทรัพย์สินของผู้ต้องโทษปรับและขายทอดตลาดตามที่ได้รับแจ้งจากศาลหรือพนักงานอัยการ ทั้งนี้ มิให้หน่วยงานของรัฐเรียกค่าฤชาธรรมเนียมหรือค่าใช้จ่ายจากผู้ดำเนินการบังคับคดี การตรวจสอบหาทรัพย์สินของผู้ต้องโทษปรับโดยพนักงานอัยการเพื่อการบังคับคดีตามวรรคสอง ให้ปฏิบัติตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่กำหนดในข้อบังคับของอัยการสูงสุด บทบัญญัติมาตรานี้ไม่กระทบต่อการที่ศาลจะมีคำสั่งตามมาตรา ๒๙ วรรคหนึ่ง

Where a person sentenced to a fine does not pay the fine within the period specified in Section 29 paragraph one, the court has the power to issue a writ of execution to seize property, or to attach claims over property, of that person in satisfaction of the fine.
For execution under paragraph one, the Civil Procedure Code applies mutatis mutandis. A court officer appointed for the purpose and the public prosecutor have the powers and duties to carry out the execution, and the execution officer has the power and duty to seize property or attach claims over property of the person sentenced to the fine and to sell it by public auction as notified by the court or by the public prosecutor. A State agency shall not charge court fees or expenses to the person carrying out the execution.
The investigation of the property of a person sentenced to a fine, carried out by the public prosecutor for the purpose of execution under paragraph two, shall comply with the rules, procedures, and conditions prescribed in the regulations of the Attorney General.
This Section does not affect the power of the court to make an order under Section 29 paragraph one.

Section 29/1 was added to give the State a civil style enforcement route against a defaulting fine payer, as an alternative to the older mechanism of detention in lieu of a fine. Paragraph one confers the power to issue a writ of execution. Paragraph two imports the Civil Procedure Code mutatis mutandis and allocates roles: an appointed court officer and the public prosecutor conduct the execution, while the execution officer seizes, attaches, and sells by auction on notification. It also bars any State agency from charging fees or expenses to the person carrying out the execution, which removes a practical obstacle to enforcement. Paragraph three subjects the prosecutor's asset tracing to regulations of the Attorney General. Paragraph four preserves the court's power under Section 29 paragraph one, so this Section supplements rather than replaces the default provisions.

The practical significance is that an unpaid fine is no longer only a matter of serving time in default. Property can be seized and sold, and the asset investigation is conducted by the public prosecutor. For a foreign national, an unpaid fine can therefore attach to assets held in Thailand long after the case appears closed. Where a fine is beyond the means of the person sentenced, the right course is to apply to the court under Section 29 and Section 30/1 for instalments or for community service, before default triggers enforcement under this Section.
