English translation
Whoever has been finally sentenced to imprisonment and again commits an offence falling within the same sub-section of the following sub-sections, whether while still liable to serve that punishment or within three years from the date of release, shall, if the first offence was one for which the court sentenced the offender to imprisonment of not less than six months, and if the court is to sentence the offender to imprisonment for the later offence, have the punishment to be imposed increased by one half of the punishment fixed by the court for that later offence:
(1) offences against the security of the Kingdom as provided in Section 107 to Section 135;
(2) offences against officials as provided in Section 136 to Section 146;
(3) offences of malfeasance in office as provided in Section 147 to Section 166;
(4) offences against officials in the administration of justice as provided in Section 167 to Section 192 and Section 194;
(5) offences of malfeasance in judicial office as provided in Section 200 to Section 204;
(6) offences against public peace as provided in Section 209 to Section 216;
(7) offences of causing danger to the public as provided in Section 217 to Section 224, Section 226 to Section 234, and Section 236 to Section 238;
(8) offences relating to currency as provided in Section 240 to Section 249, offences relating to seals, stamps and tickets as provided in Section 250 to Section 261, and offences relating to documents as provided in Section 264 to Section 269;
(9) offences relating to trade as provided in Section 270 to Section 275;
(10) sexual offences as provided in Section 276 to Section 285;
(11) offences against life as provided in Section 288 to Section 290 and Section 294, offences against the body as provided in Section 295 to Section 299, the offence of causing abortion as provided in Section 301 to Section 303, and the offence of abandoning a child, a sick person, or an aged person as provided in Section 306 to Section 308;
(12) offences against liberty as provided in Section 309, Section 310, and Section 312 to Section 320;

Section 93 is the aggravated recidivism rule. Its elements are stricter than Section 92: a prior final sentence of at least six months' imprisonment, and a later offence of the same statutory category committed either while still serving or within three years of release. When met, the increase is one half rather than the one third under Section 92. The section defines same category by reference to thirteen numbered categories, from offences against the security of the Kingdom through offences against property, so the enhancement bites only where the old and new offences share a listed category. It remains subject to Section 94, which removes negligent, petty, and under-eighteen offences from the enhancement calculus.
Why this matters in practice
Same-category repeat offending carries a heavier penalty exposure than general recidivism: the increase is one half, not one third, and it applies even while the earlier sentence is still being served. Whether the enhancement bites turns on the category match, so a defence may contest that the prior and current offences fall in different titles, or that the prior sentence was under six months or too old to count. As with Section 92, the enhancement is normally pleaded and identity confirmed, and Section 94 exclusions still apply. The defendant was convicted of theft and, as a same-category repeat offender, had the base term of four years and six months increased by one half under Section 93 to six years and nine months before mitigation for the guilty plea was applied.

En quoi l'article 93 diffère-t-il de l'article 92 ?
L'article 92 ajoute un tiers pour toute récidive punissable d'un emprisonnement, commise soit pendant que le délinquant subit encore la peine précédente, soit dans les cinq ans suivant sa libération. L'article 93 ajoute la moitié, mais seulement lorsque la peine antérieure était d'au moins six mois d'emprisonnement et que la nouvelle infraction relève de la même des treize catégories énumérées, commise alors qu'il est encore passible de l'exécution de cette peine ou dans un délai de trois ans.
