เจ้าของรวมคนหนึ่ง ๆ อาจใช้สิทธิอันเกิดแต่กรรมสิทธิ์ครอบไปถึงทรัพย์สินทั้งหมดเพื่อต่อสู้บุคคลภายนอก แต่ในการเรียกร้องเอาทรัพย์สินคืนนั้น ท่านว่าต้องอยู่ในบังคับแห่งเงื่อนไขที่ระบุไว้ในมาตรา ๓๐๒ แห่งประมวลกฎหมายนี้
