The marriage adjudged is void shall not prejudice the rights acquired by third person acting in good faith before entering the void of the marriage into the Marriage Register under Section 1497/1.

บทบัญญัตินี้คุ้มครองบุคคลภายนอกผู้สุจริตจากผลย้อนหลังของการสมรสที่เป็นโมฆะ จุดตัดอยู่ที่การบันทึกความเป็นโมฆะไว้ในทะเบียนสมรสตามมาตรา 1497/1 สิทธิที่บุคคลภายนอกได้มาโดยสุจริตก่อนวันที่มีการบันทึกย่อมไม่เสียไป แม้ภายหลังจะมีคำพิพากษาว่าการสมรสนั้นเป็นโมฆะ ในทางปฏิบัติ ผู้ที่ทำนิติกรรมกับคู่สมรสจึงควรตรวจทะเบียนสมรส ณ เวลาที่ทำนิติกรรม และผู้ที่ได้คำพิพากษาว่าการสมรสเป็นโมฆะควรรีบดำเนินการบันทึกลงทะเบียนสมรส เพราะวันที่บันทึกเป็นสิ่งที่กำหนดว่าบุคคลภายนอกรายใดยังได้รับความคุ้มครอง
