ค่าทดแทนตามมาตรา ๑๕๒๓ และมาตรา ๑๕๒๔ นั้น ให้ศาลวินิจฉัยตามควรแก่พฤติการณ์ โดยศาลจะสั่งให้ชำระครั้งเดียวหรือแบ่งชำระเป็นงวด ๆ มีกำหนดเวลาตามที่ศาลจะเห็นสมควรก็ได้ ในกรณีที่ผู้จะต้องชำระค่าทดแทนเป็นคู่สมรสของอีกฝ่ายหนึ่ง ให้ศาลคำนึงถึงจำนวนทรัพย์สินที่คู่สมรสนั้นได้รับไปจากการแบ่งสินสมรสเพราะการหย่านั้นด้วย

L’indemnité prévue aux articles 1523 et 1524 est fixée par le tribunal en fonction des circonstances. Le tribunal peut ordonner un versement unique ou échelonné, selon ce qu’il juge approprié. Si le débiteur est le conjoint de l’autre partie, sa part des biens reçus lors de la liquidation du régime matrimonial (Sin Somros) suite au divorce est également prise en compte.
