ผู้ใดจะฟ้องบุพการีของตนเป็นคดีแพ่งหรือคดีอาญามิได้ แต่เมื่อผู้นั้นหรือญาติสนิทของผู้นั้นร้องขอ อัยการจะยกคดีขึ้นว่ากล่าวก็ได้
