ถ้าค้ำประกันหนี้อันจะต้องชำระ ณ เวลามีกำหนดแน่นอนและเจ้าหนี้ยอมผ่อนเวลาให้แก่ลูกหนี้ ผู้ค้ำประกันย่อมหลุดพ้นจากความรับผิด เว้นแต่ผู้ค้ำประกันจะได้ตกลงด้วยในการผ่อนเวลานั้น ข้อตกลงที่ผู้ค้ำประกันทำไว้ล่วงหน้าก่อนเจ้าหนี้ผ่อนเวลาอันมีผลเป็นการยินยอมให้เจ้าหนี้ผ่อนเวลา ข้อตกลงนั้นใช้บังคับมิได้ ความในวรรคสอง มิให้ใช้บังคับแก่กรณีผู้ค้ำประกันซึ่งเป็นสถาบันการเงินหรือค้ำประกันเพื่อสินจ้างเป็นปกติธุระ[๒๒]

English translation
Where a suretyship is given for an obligation to be performed at a fixed time and the creditor grants the debtor an extension of time, the surety is released from liability, unless the surety consented to the extension.
An agreement made by the surety in advance, before the creditor grants the extension, by which the surety consents to an extension being granted, is unenforceable.
Paragraph two does not apply where the surety is a financial institution, or gives suretyship for remuneration in the ordinary course of business.

Lawyers: If a lender wishes to extend the repayment period and preserve surety liability, it must obtain the surety's written consent to the extension. An informal or oral agreement to extend time between the creditor and debtor, without the surety's consent, releases the surety. Laypeople: As a guarantor, if the bank and borrower agree to extend the loan term without asking you, you may be released from your obligation after the original due date.
Legislative history
Amended by the Civil and Commercial Code Amendment Act (No. 20) B.E. 2557 (2014), which clarified that a written extension of time by the creditor without the surety's written consent releases the surety from liability accruing after the original due date.

A surety who expressly consents in the suretyship agreement to future extensions of time remains bound despite subsequent extensions granted by the creditor.
The suretyship agreement expressly stated that if the creditor extended time for the debtor's obligation in any case, the surety consented and would remain bound. The court held this contractual consent to future extensions kept the surety bound despite subsequent extensions of the debtor's obligation.
