ในคดีที่คำขอให้ปลดเปลื้องทุกข์นั้นอาจคำนวณเป็นราคาเงินได้ ให้โจทก์เสียค่าขึ้นศาลในศาลชั้นต้นตามจำนวนทุนทรัพย์ที่เรียกร้องหรือราคาทรัพย์สินที่พิพาท

In a case where the claim for relief can be calculated as a sum of money, the plaintiff shall pay court fees in the Court of First Instance according to the amount of the claim or the value of the disputed property.
As to court fees at the appeal or Dika (Supreme Court) level, if the amount claimed or the value of the property in dispute at the appeal or Dika level is the same as in the Court of First Instance, the appellant or the Dika petitioner shall pay according to the same amount or value as in the Court of First Instance. But if the appellant or Dika petitioner has obtained satisfaction only in part under the judgment or order of the lower court, and the amount or the value of the property in dispute at the appeal or Dika level is lower than in the Court of First Instance, the appellant or Dika petitioner shall pay court fees according to that lower amount or value.
Once the court fee has been paid, if the amount in dispute of the complaint, the appeal complaint, or the Dika complaint increases through the filing of an additional complaint or by any other means, additional court fees shall be charged as prescribed in the schedule annexed to this Code, at the time the additional complaint is filed or within the period the court thinks fit, as the case may be.
If, because the court has ordered the cases to be tried together or to be separated, any complaint or any claim contained in any complaint must be transferred to another court, or must be re-filed with that court or with another court as a separate case, the plaintiff shall be granted relief from paying court fees for filing or re-filing such complaint or claim, except where the amount or the value of the property of such complaint or claim has increased. In such a case, the court fee only on the increased part shall be calculated and paid as prescribed in the preceding paragraph.
In the case where persons who are co-parties in a case whose cause of action is the performance of an indivisible obligation each file separate appeals or Dika petitions, each having paid court fees at the appeal or Dika level under paragraph two, if such court fees, when combined, exceed the court fees those parties would have had to pay had they filed a joint appeal or Dika petition, the Court of Appeal or the Supreme Court, as the case may be, shall order the excess court fees returned to those parties in proportion to the court fee each of them has paid, at the time that court renders its judgment or order.

Section 150 is the core rule for calculating ad valorem court fees (kha khuen san) in money-valued civil cases and sits at the head of Part 1 on the assessment and payment of court fees. It fixes the fee to the claim amount or disputed property value at first instance, carries that base up to the appeal and Dika levels, and reduces it where a party who won partly below now disputes a smaller sum. Paragraph three governs top-up fees when the claim grows, and paragraph four relieves the plaintiff from re-paying fees when a case is consolidated or split by court order. Paragraph five, applied in recent Dika decisions, requires refund of excess fees where co-parties with an indivisible cause of action file separate appeals or Dika petitions instead of a joint one.

Court fees are a real cash cost that scales with the value of your claim, so overstating the sum sued for inflates the fee with no benefit. Value the claim carefully before filing, budget the same fee again for each appeal, and if you are one of several co-parties with a single indivisible claim, consider a joint appeal or Dika petition: filing separately can force each of you to pay a full fee, and the refund of the excess only comes after judgment. A lawyer can confirm the correct court-fee figure before you file a lawsuit or start debt collection so you are not over- or under-paying.

Supreme Court Judgment No. 2008/2567 (2024)
Where co-defendants share an indivisible cause of action and each file a separate Dika petition, paying court fees that together exceed the fee for a joint petition, the excess must be refunded to them in proportion under Section 150 paragraph five.
Defendants 1 and 2 filed separate Dika petitions in a case with an indivisible cause of action, each paying court fees. Because the combined fees exceeded the cost of a joint petition, the Supreme Court ordered the excess refunded, returning 2,432 baht to defendant 1 and 1,778 baht to defendant 2.

Supreme Court Judgment No. 4300/2567 (2024)
When co-defendants each pay a full Dika court fee on the same indivisible claim through separate petitions, and the combined amount exceeds the fee for a joint petition, the court returns the excess in proportion to what each paid under Section 150 paragraph five.
Both defendants paid full Dika court fees, one being 35,000 baht after a partial fee waiver. Because their combined fees exceeded what a joint Dika petition would have cost, the Supreme Court ordered the excess Dika court fees returned to them in proportion to the amount each had paid.

The refund of excess court fees under Section 150 applies equally to co-plaintiffs: where co-plaintiffs with an indivisible cause of action each file a separate Dika petition and each pay full court fees, the court refunds the excess to them.
Two co-plaintiffs in a case with an indivisible cause of action filed separate Dika petitions, each paying a full court fee on the value in dispute. The Supreme Court held it proper to refund the excess Dika court fees, returning 100,000 baht to each plaintiff.

How much is the court fee for a civil money claim in Thailand?
Under Section 150 the court fee is calculated on the amount claimed or the value of the disputed property, at the rates in the schedule annexed to the Code. The same base applies again at the appeal and Dika levels.
Do I pay court fees again when I appeal?
Yes. Section 150 requires the appellant or Dika petitioner to pay a court fee on the same disputed amount, unless you won partly below and now dispute a smaller sum, in which case you pay on the lower figure.
