English translation

Whoever makes a false electronic card in whole or in part, adds to or removes text, or alters by any means a genuine electronic card, in a manner likely to cause damage to another person or to the public, if the act is done in order to make any person believe that it is a genuine electronic card or in order to obtain any benefit, commits the offence of forging an electronic card and shall be liable to imprisonment from one year to five years and a fine from twenty thousand baht to one hundred thousand baht.

Section 269/1 is the base offence of the Chapter on Offences Relating to Electronic Cards and the card analogue of document forgery under Section 264. The term electronic card is not defined in this Section but in Section 1(14) of the General Part, and the definition is deliberately wide: it covers a physical card and the data recorded on it, intangible data, codes, account numbers, and electronic serial numbers issued without any card, and anything else used with electronic data to identify the holder. The elements are: (1) making a false electronic card wholly or partly, or adding to, removing from, or altering a genuine card; (2) a manner likely to cause damage to another person or to the public; and (3) intent either to make a person believe the card is genuine or to obtain any benefit. That second intent limb is wider than Section 264, which requires only intent to deceive as to genuineness. The penalty is cumulative, imprisonment and a fine. Sections 269/2 to 269/4 reach the forging tools, cross-border movement, and use or sale of cards forged under this Section, and Section 269/7 increases every penalty in the Chapter by one half where the card is a payment or cash withdrawal card.

Why this matters in practice

The one year minimum term and the mandatory fine make this materially heavier than ordinary document forgery under Section 264, and a fine only outcome is not available. Card cloning prosecutions are almost always multi count: the forging under this Section, the skimming or encoding equipment under Section 269/2, the use or sale under Section 269/4, and theft under Section 334 for the money taken. Because a credit, debit, or ATM card is the usual subject matter, Section 269/7 will normally apply and increase the penalty by one half, so real exposure on a single forged payment card is imprisonment from one year and six months to seven years and six months. Where several cards are made with the intent that each be used separately, courts have treated each card as a separate count.

    Each forged electronic card carries a different holder's data, a different number and a different issuing bank, and by its nature has to be forged one card at a time and used separately, so the offender does not act with a single intention and commits a separate offence for each card. Where the same person forges a card under Section 269/1 and then uses it or possesses it for use, section 269/4 paragraph three applies, and in this case the courts punished the defendant once for each card under Section 269/4 rather than separately for the forging. The cards themselves, issued for paying for goods, services or other debts in place of cash or for withdrawing cash from a bank account, are evidence of the creation, alteration, transfer, reservation or extinguishment of a right, and so are documents and documents of title within Section 1(7) and (9).

    In a prosecution spanning document forgery and electronic card offences under Sections 264, 265, 266, 269/1, 269/2, 269/4, 269/7, and 334, the court characterised the payment card as both a document and a right document, and the defendant was convicted on multiple counts.
