เด็กอายุกว่าสิบสองปีแต่ยังไม่เกินสิบห้าปี กระทำการอันกฎหมายบัญญัติเป็นความผิด เด็กนั้นไม่ต้องรับโทษ แต่ให้ศาลมีอำนาจที่จะดำเนินการ ดังต่อไปนี้ (๑) ว่ากล่าวตักเตือนเด็กนั้นแล้วปล่อยตัวไป และถ้าศาลเห็นสมควรจะเรียกบิดา มารดา ผู้ปกครอง หรือบุคคลที่เด็กนั้นอาศัยอยู่มาตักเตือนด้วยก็ได้ (๒) ถ้าศาลเห็นว่า บิดา มารดา หรือผู้ปกครองสามารถดูแลเด็กนั้นได้ ศาลจะมีคำสั่งให้มอบตัวเด็กนั้นให้แก่บิดา มารดา หรือผู้ปกครองไป โดยวางข้อกำหนดให้บิดา มารดา หรือผู้ปกครองระวังเด็กนั้นไม่ให้ก่อเหตุร้ายตลอดเวลาที่ศาลกำหนดซึ่งต้องไม่เกินสามปีและกำหนดจำนวนเงินตามที่เห็นสมควรซึ่งบิดา มารดา หรือผู้ปกครองจะต้องชำระต่อศาลไม่เกินครั้งละหนึ่งหมื่นบาท ในเมื่อเด็กนั้นก่อเหตุร้ายขึ้น ถ้าเด็กนั้นอาศัยอยู่กับบุคคลอื่นนอกจากบิดา มารดา หรือผู้ปกครอง และศาลเห็นว่าไม่สมควรจะเรียกบิดา มารดา หรือผู้ปกครองมาวางข้อกำหนดดังกล่าวข้างต้น ศาลจะเรียกตัวบุคคลที่เด็กนั้นอาศัยอยู่มาสอบถามว่า จะยอมรับข้อกำหนดทำนองที่บัญญัติไว้สำหรับบิดา มารดา หรือผู้ปกครองดังกล่าวมาข้างต้นหรือไม่ก็ได้ ถ้าบุคคลที่เด็กนั้นอาศัยอยู่ยอมรับข้อกำหนดเช่นว่านั้น ก็ให้ศาลมีคำสั่งมอบตัวเด็กให้แก่บุคคลนั้นไปโดยวางข้อกำหนดดังกล่าว (๓) ในกรณีที่ศาลมอบตัวเด็กให้แก่บิดา มารดา ผู้ปกครอง หรือบุคคลที่เด็กนั้นอาศัยอยู่ตาม (๒) ศาลจะกำหนดเงื่อนไขเพื่อคุมความประพฤติเด็กนั้นเช่นเดียวกับที่บัญญัติไว้ในมาตรา ๕๖ ด้วยก็ได้ ในกรณีเช่นว่านี้ ให้ศาลแต่งตั้งพนักงานคุมประพฤติหรือพนักงานอื่นใดเพื่อคุมความประพฤติเด็กนั้น (๔) ถ้าเด็กนั้นไม่มีบิดา มารดา หรือผู้ปกครอง หรือมีแต่ศาลเห็นว่าไม่สามารถดูแลเด็กนั้นได้หรือถ้าเด็กอาศัยอยู่กับบุคคลอื่นนอกจากบิดา มารดา หรือผู้ปกครอง และบุคคลนั้นไม่ยอมรับข้อกำหนดดังกล่าวใน (๒) ศาลจะมีคำสั่งให้มอบตัวเด็กนั้นให้อยู่กับบุคคลหรือองค์การที่ศาลเห็นสมควรเพื่อดูแล อบรม และสั่งสอนตามระยะเวลาที่ศาลกำหนดก็ได้ในเมื่อบุคคลหรือองค์การนั้นยินยอม ในกรณีเช่นว่านี้ให้บุคคลหรือองค์การนั้นมีอำนาจเช่นผู้ปกครองเฉพาะเพื่อดูแล อบรม และสั่งสอน รวมตลอดถึงการกำหนดที่อยู่และการจัดให้เด็กมีงานทำตามสมควร หรือให้ดำเนินการคุ้มครองสวัสดิภาพเด็กตามกฎหมายว่าด้วยการนั้นก็ได้ หรือ (๕) ส่งตัวเด็กนั้นไปยังโรงเรียน หรือสถานฝึกและอบรม หรือสถานที่ซึ่งจัดตั้งขึ้นเพื่อฝึกและอบรมเด็ก ตลอดระยะเวลาที่ศาลกำหนด แต่อย่าให้เกินกว่าที่เด็กนั้นจะมีอายุครบสิบแปดปี คำสั่งของศาลดังกล่าวใน (๒) (๓) (๔) และ (๕) นั้น ถ้าในขณะใดภายในระยะเวลาที่ศาลกำหนดไว้ ความปรากฏแก่ศาลโดยศาลรู้เอง หรือตามคำเสนอของผู้มีส่วนได้เสีย พนักงานอัยการ หรือบุคคลหรือองค์การที่ศาลมอบตัวเด็กเพื่อดูแล อบรมและสั่งสอน หรือเจ้าพนักงานว่า พฤติการณ์เกี่ยวกับคำสั่งนั้นได้เปลี่ยนแปลงไป ก็ให้ศาลมีอำนาจเปลี่ยนแปลงแก้ไขคำสั่งนั้น หรือมีคำสั่งใหม่ตามอำนาจในมาตรานี้

A child over twelve but not over fifteen years of age who commits an act that the law provides to be an offence shall not be punished, but the court has the power to take the following actions:
(1) to admonish the child and then release the child, and if the court thinks fit it may also summon the father, mother, guardian, or the person with whom the child resides to be admonished;
(2) if the court is of the opinion that the father, mother, or guardian is able to take care of the child, to order the child to be delivered to the father, mother, or guardian, laying down a requirement that they shall watch over the child so as not to commit an act of mischief throughout the period fixed by the court, which must not exceed three years, and fixing such sum of money as the court thinks fit, not exceeding ten thousand baht on each occasion, which they must pay to the court if the child commits an act of mischief. If the child resides with a person other than the father, mother, or guardian, and the court is of the opinion that it is not appropriate to summon the father, mother, or guardian to have such a requirement laid down, the court may summon the person with whom the child resides and ask whether that person will accept a requirement of the kind provided above; and if that person accepts it, the court shall order the child to be delivered to that person, laying down that requirement;
(3) where the court delivers the child to the father, mother, guardian, or the person with whom the child resides under (2), the court may also fix conditions for controlling the child's conduct in the same way as provided in Section 56, and in such a case the court shall appoint a probation officer or any other official to control the child's conduct;
(4) if the child has no father, mother, or guardian, or has one but the court is of the opinion that they are unable to take care of the child, or if the child resides with a person other than the father, mother, or guardian and that person does not accept the requirement mentioned in (2), to order the child to be delivered to such person or organisation as the court thinks fit, to take care of, train, and instruct the child for the period fixed by the court, where that person or organisation consents. In such a case that person or organisation has the powers of a guardian only for the purposes of taking care of, training, and instructing the child, including fixing the child's place of residence and arranging suitable work for the child, or child welfare protection may be undertaken under the law relating to that; or
(5) to send the child to a school, to a training and instruction institution, or to a place established for the training and instruction of children, for the period fixed by the court, but not beyond the time when the child attains the age of eighteen years.
As to an order of the court under (2), (3), (4), and (5), if at any time within the period fixed by the court it appears to the court, of its own knowledge or on the submission of an interested person, of the public prosecutor, of the person or organisation to whom the child was delivered for care, training, and instruction, or of an official, that the circumstances relating to that order have changed, the court has the power to vary or amend that order, or to make a new order under the powers in this Section.

Un enfant âgé de 12 à 15 ans n'est toujours pas puni, mais contrairement à l'article 73, le tribunal dispose de quatre options de réhabilitation et de protection, allant de l'avertissement au placement dans un établissement de formation jusqu'à l'âge de dix-huit ans. La mesure de surveillance prévue au paragraphe (2) est appliquée par l'article 77, qui autorise le tribunal à exiger le paiement d'une caution ou à en modifier les conditions si la personne responsable ne parvient pas à contrôler l'enfant. La limite avec l'article 75 est nette : à quinze ans exactement, l'enfant sort de la catégorie des personnes non punissables et s'expose à une condamnation discrétionnaire, la peine étant réduite de moitié.
Pourquoi cela est important en pratique
Pour un enfant de cette tranche d'âge, la conséquence concrète n'est jamais une amende ou une peine d'emprisonnement, mais une mesure supervisée par le tribunal. Les questions essentielles sont donc de savoir quelle mesure s'applique et quelles sont les obligations des parents. Les parents chargés de la garde de l'enfant en vertu du paragraphe (2) acceptent un risque financier : ils peuvent être condamnés à payer la somme fixée par le tribunal chaque fois que l'enfant cause un nouveau préjudice. La question préalable est de confirmer que l'enfant était âgé de plus de douze ans mais de moins de quinze ans au moment des faits, car elle détermine la distinction entre l'absence de sanction et la réduction de peine prévue à l'article 75.

L'accusé, âgé de quatorze ans à l'époque, a été reconnu coupable d'une infraction mais n'a pas été puni en vertu de l'article 74. Le tribunal a averti l'accusé, l'a renvoyé au tuteur et lui a imposé une caution exigeant un paiement si l'accusé causait un nouveau préjudice dans un délai d'un an.

Un enfant de moins de quinze ans n'encourt aucune punition, mais le tribunal peut ordonner son placement dans un centre de formation et d'instruction pour mineurs, jusqu'à l'âge de dix-huit ans.
L’accusé, alors âgé de quatorze ans, a commis les infractions d’enlèvement d’enfant et d’attentat à la pudeur. Non passible des peines prévues à l’article 74, il a été placé dans un centre de rééducation pour mineurs pour une durée minimale d’un an et maximale de deux ans, jusqu’à sa majorité (18 ans).
