Lorsqu'une servitude n'affecte qu'une partie du fonds servant, le propriétaire de ce fonds peut, en démontrant que la charge serait à son avantage et en s'engageant à en supporter le coût, exiger que la servitude soit transférée à une autre partie de son fonds, à condition que cela ne soit pas moins avantageux pour le propriétaire du fonds dominant.
