อันว่าทรัสต์นั้น จะก่อตั้งขึ้นโดยตรงหรือโดยทางอ้อมด้วยพินัยกรรมหรือด้วยนิติกรรมใด ๆ ที่มีผลในระหว่างชีวิตก็ดีหรือเมื่อตายแล้วก็ดี หามีผลไม่ เว้นแต่โดยอาศัยอำนาจตามบทบัญญัติแห่งกฎหมายเพื่อการก่อตั้งทรัสต์เท่านั้น

English translation
A trust created, whether directly or indirectly, by will or by any juristic act taking effect during lifetime or after death, has no effect, except by virtue of the provisions of a law enacted for the creation of trusts.
