traduction anglaise

A will may be made as a document written entirely by the testator, namely: the testator must write with his own hand the whole of its text, the date, and his signature.

No erasure, omission, addition or other alteration to such a will is valid unless the testator has made it with his own hand and has signed his name beside it.

Section 9 of this Code does not apply to a will made under this Section.

Annotation de l'entreprise

Section 1657 is the no-witness option, simpler but more easily challenged. Requirements: entire text (not just signature) handwritten by the testator; testator's signature; date. If any part is typed or written by another person, the will fails as holographic. Common firm practice: discourage clients from holographic wills, easier to forge, easier to allege duress or lack of capacity, no witnesses to corroborate. Better to use §1656 ordinary or §1658 public form.
