A short video from ThaiLawOnline on legal due diligence and contract review for foreigners buying property in Thailand. Below the video you will find the key checks in writing, common questions and a link to our full guide.

Key points

  • Check the title deed at the Land Office itself, not only a copy: the type of title (a Chanote is the strongest), the registered owner and every registered right.
  • Look for encumbrances such as a mortgage, lease, usufruct or superficies registered against the land.
  • Verify building permits, zoning and land use rules before you commit.
  • Foreigners generally cannot own land in Thailand; condominium units can be owned within the 49 percent foreign quota of the building.
  • Have the sale contract reviewed before paying a deposit: deadlines, refund terms and who pays transfer fees and taxes.

These points summarise the law as set out in our full guide, Vérification préalable des biens immobiliers en Thaïlande, which is reviewed regularly. The video gives an overview; the written guide is the up to date reference.

Foire aux questions

Why is due diligence important when buying property in Thailand?

Because the registered title, encumbrances and permits decide what you actually buy. Problems found after transfer are far harder and more expensive to fix.

Un étranger peut-il posséder des terres en Thaïlande ?

Generally no. Foreigners can own a condominium unit within the foreign quota, and can use land through a registered lease, usufruct or superficies.
