Every document below is produced in English and Thai side by side, formatted for signature, and delivered as Word and PDF. Each one carries the notes a Thai lawyer would give you when handing it over: which section of the Civil and Commercial Code governs it, who must witness it, and what to do with it after you sign.
What you can produce
Wills and end-of-life
- Testament — for assets in Thailand. Divide your estate between one heir or up to ten, each with a percentage. Names an administrator, and a backup if you want one. Signed before two witnesses under section 1656.
- Testament de vie — a declaration refusing life-sustaining treatment, made under section 12 of the National Health Act B.E. 2550. You may name someone to speak for you, or not.
Propriété
- Land Lease Agreement — up to the 30-year maximum a registered lease may run under section 540, for one or two lessees.
- Lease Addendum — with a renewal structure drafted to survive Supreme Court decision 4655/2566, which struck down the automatic-renewal clauses still common in Thailand.
- Declaration of Intention to Renew et Receipt of Payment — the two documents that go with a lease.
- Contrat d'usufruit — a registered lifetime right to use and take the fruits of land you cannot own. The standard answer for a foreigner whose Thai partner holds the title deed.
Money
- Contrat de prêt — secured by mortgage, for up to three borrowers who are jointly and severally liable. Interest capped at 15 percent a year under section 654.
- Billet à ordre — a negotiable instrument under section 982. Remember you must sue within three years of maturity, where a loan agreement gives you ten.
Famille
- contrat prénuptial — with full financial disclosure schedules for both parties. It must be entered in the marriage register at the time you register the marriage, or under section 1466 it does not bind anyone else.
What the wording actually looks like
Four extracts from the real templates, so you can judge the drafting before you join. Each document runs to many more clauses than these.
“Even with the rights of usufruct, the Usufructuary agrees and understands that the land is the property of the owner. The Usufructuary has no intention to take possession of land for his/her own in any way and the owner of the land is not a ‘nominee’.”
“แม้จะมีสิทธิเก็บกิน ผู้ทรงสิทธิตกลงและทราบดีว่า ที่ดินเป็นทรัพย์สินของเจ้าของ ผู้ทรงสิทธิมิได้มีเจตนาที่จะยึดถือครอบครองที่ดินเพื่อตนแต่ประการใด และเจ้าของที่ดินมิได้เป็น ‘ผู้ถือครอบครองแทน’”
Why it is there: the nominee question is what Land Offices are asking foreigners about right now. This clause puts the answer inside the contract instead of leaving it to a conversation at the counter.
“The parties agree that ‘WHEREAS, AND WHEREAS’ clauses shall be deemed contractual in nature and not mere recitals.”
“คู่สัญญาตกลงว่า ‘โดยที่ และโดยที่’ จะให้ถือเป็นส่วนหนึ่งในเนื้อหาแห่งสัญญาและมิใช่เป็นเพียงอารัมภบทเท่านั้น”
Why it is there: in most contracts the opening “whereas” paragraphs are background and cannot be enforced. One sentence turns everything recited about the land, the deed and the parties into terms you can sue on.
“If any beneficiary under this Will contests in any court any of the provisions of this Will, then each and all such persons shall not be entitled to any devises, legacies, bequests, or benefits under this Will or any codicil hereto, and such interest or share in my estate shall be disposed of as if that contesting beneficiary had not survived me.”
Why it is there: an heir who sues to break the will risks losing what the will already gave them. It is the single clause that does most to keep a Thai estate out of court.
“You must sue within THREE YEARS of the maturity date (Section 1001). Do not wait. A loan agreement gives ten years; a note gives only three.”
Why it is there: every document arrives with the notes a Thai lawyer would give you across the desk. Choosing a promissory note over a loan agreement quietly cuts seven years off the time you have to collect, and most people are never told.
These are extracts, shortened for the page. Every document is many clauses longer: the Usufruct Agreement runs past clause 15, and the Prenuptial Agreement carries four financial disclosure schedules on top of its sixteen clauses.
