เมื่อหย่ากันแล้ว ให้จัดการแบ่งทรัพย์สินของคู่สมรส แต่ในระหว่างสมรส
(ก) ถ้าเป็นการหย่าโดยความยินยอมของทั้งสองฝ่าย ให้จัดการแบ่งทรัพย์สินของคู่สมรสตามที่มีอยู่ในเวลาจดทะเบียนการหย่า
(ข) ถ้าเป็นการหย่าโดยคำพิพากษาของศาล คำพิพากษาส่วนที่บังคับทรัพย์สินระหว่างคู่สมรสนั้น มีผลย้อนหลังไปถึงวันฟ้องหย่า

English translation
After a divorce, the property of the spouses shall be divided; but as between them during the marriage:
(a) where the divorce is by mutual consent, the property of the spouses shall be divided as it stood at the time of registration of the divorce;
(b) where the divorce is by judgment of the court, the part of the judgment enforcing the property rights between the spouses takes effect retrospectively to the day on which the divorce action was brought.
