โทษจำคุกให้เริ่มแต่วันมีคำพิพากษา แต่ถ้าผู้ต้องคำพิพากษาถูกคุมขังก่อนศาลพิพากษา ให้หักวันที่ถูกคุมขังออกจากระยะเวลาจำคุกตามคำพิพากษา เว้นแต่คำพิพากษานั้นจะกล่าวไว้เป็นอย่างอื่น
ในกรณีที่ผู้ต้องคำพิพากษาถูกคุมขังก่อนมีคำพิพากษา ให้ศาลสั่งให้หักวันคุมขังดังกล่าว แต่จำนวนวันที่หักรวมกับระยะเวลาจำคุกตามคำพิพากษา ต้องไม่เกินอัตราโทษขั้นสูงของความผิดนั้น

Imprisonment shall begin on the day on which the judgment is passed. But if the convicted person was held in custody prior to the judgment, the days of such custody shall be deducted from the period of imprisonment under the judgment, unless the judgment otherwise provides.
In the case where the convicted person was held in custody prior to the judgment, the Court shall order the deduction of such days of custody, but the total number of days deducted and the period of imprisonment under the judgment shall not exceed the maximum punishment prescribed for such offence.
