Whoever commits an offence outside the Kingdom and is to be punished within the Kingdom as provided in Section 7, Section 8 or Section 9, if there is a judgment of a foreign court in respect of such act:
(1) If the final judgment acquits such person, such person shall not be prosecuted again within the Kingdom;
(2) If the final judgment convicts such person and such person has undergone the full punishment, such person shall not be prosecuted again within the Kingdom;
(3) If the final judgment convicts such person but such person has not undergone the punishment or has undergone only part thereof, such person may be prosecuted within the Kingdom, but if such person has undergone part of the punishment under the judgment of the foreign court, the Court may impose a punishment less than that provided by law for such offence to any extent, or may not impose any punishment at all.
A Thai national who commits an offence outside the Kingdom and has been prosecuted in a foreign court at the request of the Thai Government, if the final judgment acquits such person, or if such person has undergone the full punishment under the judgment, such person shall not be prosecuted again within the Kingdom.
