ผู้ใดต้องโทษกักขัง ให้กักตัวไว้ในสถานที่กักขังที่กำหนดไว้ ซึ่งมิใช่เรือนจำ สถานีตำรวจ หรือสถานที่ควบคุมผู้ต้องหาของพนักงานสอบสวน
ในกรณีที่ศาลเห็นสมควร ศาลจะสั่งให้กักขังผู้ต้องโทษในที่อาศัยของผู้นั้นเอง หรือของผู้อื่นที่ยินยอมรับผู้นั้นไว้ก็ได้ ถ้าศาลเห็นเป็นการสมควรเพื่อป้องกันการหลบหนี ศาลจะกำหนดเงื่อนไขอย่างหนึ่งอย่างใดด้วยก็ได้

Any person who is sentenced to confinement shall be confined in a place of confinement designated for such purpose, which is not a prison, a police station, or a place for the detention of the accused by an inquiry official.
In the case where the Court thinks fit, the Court may order the confinement of such person at his own dwelling or at the dwelling of another person who consents to receive him. If the Court thinks it necessary for the prevention of escape, the Court may prescribe any conditions.
