แต่ถ้าผู้กระทำความผิดยังสามารถรู้ผิดชอบอยู่บ้าง หรือยังสามารถบังคับตนเองได้บ้าง ผู้กระทำความผิดนั้นต้องรับโทษสำหรับความผิดนั้น แต่ศาลจะลงโทษน้อยกว่าที่กฎหมายกำหนดไว้สำหรับความผิดนั้นเพียงใดก็ได้

Whoever commits an offence while unable to appreciate the nature or illegality of the act, or unable to control himself, owing to a deficiency of mind, mental disease, or mental infirmity, shall not be punished for such offence.
But if the offender is still partially able to appreciate the nature or illegality of the act, or still partially able to control himself, the offender shall be punished for such offence, but the Court may impose a punishment less than that provided by law for such offence to any extent.
