If the law in force at the time of the commission of an offence is different from the law in force at a subsequent time, the law which is the most favorable to the offender shall apply, except where the case has been decided by a final judgment, in which case:
(1) If the offender has not yet undergone the punishment or is undergoing the punishment, and the punishment determined by the judgment is heavier than the maximum punishment under the law provided later, the Court may, if it thinks fit, determine the punishment anew according to the law provided later. In such case, the punishment under the original judgment which has already been undergone shall be deemed the punishment under the new judgment.
(2) If the Court has sentenced the offender to death and, according to the law provided later, the maximum punishment for such offence has been changed to another kind, the death sentence under the judgment shall be deemed to have been changed to the maximum punishment prescribed by the law provided later for such offence.
