ในกรณีที่มีการใช้ให้กระทำความผิด โฆษณาหรือประกาศให้กระทำความผิด หรือสนับสนุนในการกระทำความผิด ผู้ใช้ ผู้โฆษณาหรือประกาศ หรือผู้สนับสนุน ต้องรับโทษเพียงที่กำหนดไว้สำหรับความผิดที่ใช้ ที่โฆษณาหรือประกาศ หรือที่สนับสนุนนั้น แม้ผู้ถูกใช้จะได้กระทำเกินขอบเขตที่ใช้ หรือผู้กระทำความผิดจะได้กระทำเกินขอบเขตที่โฆษณาหรือประกาศ หรือเกินขอบเขตที่สนับสนุน
แต่ถ้าการที่เกินขอบเขตนั้น อาจเล็งเห็นได้ว่าจะเป็นผลที่ตามธรรมดาย่อมเกิดขึ้นได้ ผู้ใช้ ผู้โฆษณาหรือประกาศ หรือผู้สนับสนุน ต้องรับผิดในผลที่เกินขอบเขตนั้นด้วย
ในกรณีที่ผู้กระทำความผิดต้องรับโทษหนักขึ้นเพราะผลที่เกิดจากการกระทำความผิดนั้น ผู้ใช้ ผู้โฆษณาหรือประกาศ หรือผู้สนับสนุนจะต้องรับโทษหนักขึ้นเพราะผลนั้นก็ต่อเมื่อตนได้รู้หรือควรจะได้รู้ว่าผลเช่นนั้นจะเกิดขึ้น

In the case of instigation, propagation or publication, or support in the commission of an offence, the instigator, propagator or publisher, or supporter shall be liable only to the punishment provided for the offence so instigated, propagated, published, or supported, even though the person instigated has acted beyond the scope of the instigation, or the offender has acted beyond the scope of the propagation, publication, or support.
But if the act beyond the scope could be foreseen as a consequence that would ordinarily occur, the instigator, propagator or publisher, or supporter shall also be liable for such consequence.
In the case where the offender is liable to a heavier punishment because of the consequence of the offence, the instigator, propagator or publisher, or supporter shall be liable to such heavier punishment only if he knew or ought to have known that such consequence would occur.
But if the act beyond the scope could be foreseen as a consequence that would ordinarily occur, the instigator, propagator or publisher, or supporter shall also be liable for such consequence.
In the case where the offender is liable to a heavier punishment because of the consequence of the offence, the instigator, propagator or publisher, or supporter shall be liable to such heavier punishment only if he knew or ought to have known that such consequence would occur.
