Whoever, dishonestly deceives a person with the assertion of a falsehood or the concealment of the facts which should be revealed, and, by such deceit, obtains a property from the person so deceived or a third person, or causes the person so deceived or a third person to execute, revoke, or destroy a document of right, commits the offense of fraud, and shall be punished with imprisonment not exceeding three years or fined not exceeding sixty thousand Baht, or both.
Section 341 defines fraud: whoever dishonestly deceives a person by false pretenses or concealing facts to obtain property. Punishment is up to 3 years imprisonment and/or fine up to 60,000 Baht. Online scams and investment fraud are increasingly prosecuted under this section.
The defendant issued multiple checks to the complainant in payment for goods, knowing at the time of issuance that there were insufficient funds in the account to honor the checks. When the checks were presented for payment, they were dishonored. The Supreme Court convicted the defendant of fraud under Section 341 in conjunction with the aggravated fraud provision of Section 348. The Court held that knowingly issuing checks without sufficient funds, with the intent to deceive the payee into parting with property in reliance on the checks, constitutes fraud. The use of checks as an instrument of deception constitutes an aggravating factor. The defendant's knowledge of insufficient funds at the time of issuance was established through evidence of the account balance.
The defendant posted false advertisements on an internet marketplace offering electronic goods for sale at below-market prices. Multiple victims transferred money to the defendant's bank account but never received the goods. The Supreme Court convicted the defendant of fraud under Section 341, holding that online fraud through false sale listings on internet platforms constitutes the same offense as traditional fraud. The medium of communication does not alter the nature of the offense. Posting false sale advertisements with no intention of delivering the goods, thereby inducing victims to transfer money, satisfies all elements of fraud. The Court further noted that each transaction constituted a separate count of fraud.
The defendant falsely represented himself as a real estate agent with authority to sell a property belonging to another person. The victim, relying on the defendant's misrepresentations and forged documents, paid money to the defendant as a deposit. The Supreme Court convicted the defendant of fraud under Section 341. The Court held that fraud requires: (1) a dishonest or deceitful act, (2) the assertion of a falsehood or concealment of material facts, (3) inducing the victim to act upon the misrepresentation, and (4) the victim suffering damage by disposing of property or other rights. All four elements were established in this case.
The Supreme Court emphasized that 'dishonesty' (โดยทุจริต) under Section 1(1) is a subjective element that must exist at the time of the act. The defendant's state of mind and intention to obtain an advantage to which he was not legally entitled must be proven as existing at the moment of the criminal conduct, not before or after. This decision is a key authority on the mens rea requirement for property offences including theft, fraud, and misappropriation.
The defendant forged land title documents and used them to commit fraud. The Supreme Court applied the 'single act, multiple offences' principle under Section 90. Forging a document (Section 266), using a forged document (Section 268), and fraud (Section 341) committed as one continuous act constitute multiple offences from a single act. The court imposes the punishment for the most serious offence only.
