ถ้าการกระทำความผิดตามมาตรา ๓๑๐ ได้กระทำโดยทำให้ผู้ถูกหน่วงเหนี่ยว ถูกกักขัง หรือต้องปราศจากเสรีภาพในร่างกายนั้นตกอยู่ในภาวะที่ไม่สามารถช่วยตนเองได้ ผู้กระทำต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ
ถ้าความผิดตามวรรคแรกเป็นเหตุให้ผู้ถูกกระทำรับอันตรายสาหัส ผู้กระทำต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท
ถ้าเป็นเหตุให้ผู้ถูกกระทำถึงแก่ความตาย ผู้กระทำต้องระวางโทษจำคุกตั้งแต่สองปีถึงยี่สิบปี และปรับตั้งแต่สี่หมื่นบาทถึงสี่แสนบาท

If the commission of the offence mentioned in Section 310 is committed by placing the person confined, detained or deprived of liberty of body in a condition of being unable to help himself or herself, the offender shall be punished with imprisonment not exceeding five years or fined not exceeding one hundred thousand Baht, or both.
If the offence under paragraph one causes grievous bodily harm to the person so injured, the offender shall be punished with imprisonment of one to ten years and fined of twenty thousand to two hundred thousand Baht.
If it causes death to the person so injured, the offender shall be punished with imprisonment of two to twenty years and fined of forty thousand to four hundred thousand Baht.
If the offence under paragraph one causes grievous bodily harm to the person so injured, the offender shall be punished with imprisonment of one to ten years and fined of twenty thousand to two hundred thousand Baht.
If it causes death to the person so injured, the offender shall be punished with imprisonment of two to twenty years and fined of forty thousand to four hundred thousand Baht.
