If any fact, were it to exist, would render the act not an offence, or would exempt the offender from punishment, or would render the offender liable to a lesser punishment, even though such fact does not actually exist but the offender mistakenly believes it to exist, the offender shall not be guilty, or shall be exempt from punishment, or shall receive a lesser punishment, as the case may be.
If the ignorance of the facts referred to in the first paragraph was due to the negligence of the offender, the offender shall be liable for negligence in the case where the law specifically provides that the offender shall be punished even when acting by negligence.
For a person to receive a heavier punishment on account of any fact, such person must have known such fact.
