ผู้ใดกระทำการอันเป็นความผิดอาญาดังต่อไปนี้
(๑) ใช้กำลังประทุษร้าย หรือกระทำการใดอันก่อให้เกิดอันตรายต่อชีวิต หรืออันตรายอย่างร้ายแรงต่อร่างกายหรือเสรีภาพของบุคคลใดๆ
(๒) กระทำการใดอันก่อให้เกิดความเสียหายอย่างร้ายแรงแก่ระบบการขนส่งสาธารณะ ระบบโทรคมนาคม หรือโครงสร้างพื้นฐานอันเป็นประโยชน์สาธารณะ
(๓) กระทำการใดอันก่อให้เกิดความเสียหายแก่ทรัพย์สินของรัฐ หน่วยงานของรัฐ หรือบุคคลใด หรือต่อสิ่งแวดล้อม อันเป็นการก่อวินาศกรรม
ถ้าการกระทำนั้นได้กระทำโดยมีความมุ่งหมายเพื่อขู่เข็ญหรือบังคับรัฐบาลไทย รัฐบาลต่างประเทศ หรือองค์การระหว่างประเทศ ให้กระทำหรือไม่กระทำการอย่างหนึ่งอย่างใด หรือเพื่อสร้างความปั่นป่วนโดยให้เกิดความหวาดกลัวในหมู่ประชาชน ผู้นั้นกระทำความผิดฐานก่อการร้าย ต้องระวางโทษประหารชีวิต จำคุกตลอดชีวิต หรือจำคุกตั้งแต่สามปีถึงยี่สิบปี และปรับตั้งแต่หกหมื่นบาทถึงหนึ่งล้านบาท
การกระทำในระหว่างการเดินทางของอากาศยาน ตั้งแต่เวลาที่ประตูอากาศยานปิดก่อนออกเดินทางจนถึงเวลาที่ประตูอากาศยานเปิดหลังถึงจุดหมาย หรือถ้าอากาศยานถูกบังคับลง ณ ที่ใด ตั้งแต่เวลาที่ประตูอากาศยานปิดก่อนออกเดินทางจนกว่าเจ้าหน้าที่ผู้มีอำนาจจะเข้ารับผิดชอบอากาศยานและบุคคลกับทรัพย์สินในอากาศยาน ให้ถือว่าเป็นการกระทำความผิดฐานก่อการร้ายตามวรรคหนึ่งด้วย
ถ้าผู้กระทำความผิดฐานก่อการร้ายกระทำให้บุคคลอื่นถึงแก่ความตาย ต้องระวางโทษประหารชีวิต

Whoever commits any of the following criminal acts:
(1) Uses violence, or commits any act causing danger to life, or serious harm to body or liberty of any person;
(2) Commits any act causing serious damage to a public transportation system, telecommunication system, or infrastructure serving the public interest;
(3) Commits any act causing damage to the property of the State, a government agency, or any person, or to the environment, which constitutes sabotage,
if such act is committed with the intent to coerce or intimidate the Thai Government, a foreign government, or an international organization to perform or refrain from performing any act, or to cause panic among the public, such person commits the offence of terrorism and shall be punished with death, imprisonment for life, or imprisonment of three to twenty years and a fine of sixty thousand to one million Baht.
Any act committed during the flight of an aircraft, from the time the door is closed prior to departure until the time the door is opened after arrival, or if the aircraft is forced to land at any place, from the time the door is closed prior to departure until the competent authority takes responsibility for the aircraft, persons and property on board, shall also be deemed an offence of terrorism under paragraph one.
If the offence of terrorism causes death to another person, the offender shall be punished with death.
