ผู้ใดสมคบกันตั้งแต่ห้าคนขึ้นไป เพื่อกระทำความผิดอย่างหนึ่งอย่างใดตามที่บัญญัติไว้ในภาค ๒ แห่งประมวลกฎหมายนี้ และความผิดนั้นมีกำหนดโทษจำคุกอย่างสูงตั้งแต่หนึ่งปีขึ้นไป ต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ
ถ้าเป็นการสมคบเพื่อกระทำความผิดที่มีกำหนดโทษจำคุกอย่างสูงตั้งแต่สามปีขึ้นไป ผู้สมคบต้องระวางโทษจำคุกไม่เกินเจ็ดปี หรือปรับไม่เกินหนึ่งแสนสี่หมื่นบาท หรือทั้งจำทั้งปรับ

Whoever conspires with five or more persons to commit any offence provided in Book 2 of this Code, the said offence being punishable with imprisonment of a maximum of one year upwards, shall be punished with imprisonment not exceeding five years or a fine not exceeding one hundred thousand Baht, or both.
If it is a conspiracy to commit an offence punishable with imprisonment of a maximum of three years upwards, the conspirators shall be punished with imprisonment not exceeding seven years or a fine not exceeding one hundred and forty thousand Baht, or both.
If it is a conspiracy to commit an offence punishable with imprisonment of a maximum of three years upwards, the conspirators shall be punished with imprisonment not exceeding seven years or a fine not exceeding one hundred and forty thousand Baht, or both.
